Hourly Salary Range: $40.08 - $50.14

Annual Salary Range: $78,156 - $97,773

Pay Level: 20

Bi-Weekly Hours: 75.0 hours bi-weekly

This position is responsible for providing information, advice and assistance to workers and dependents in their claims for workers compensation from the Workers Compensation Board of Prince Edward Island. The Worker Advisor provides independent and specialized legal advice, support, and representation for workers and their dependents on Internal Reconsiderations, appeals to the Workers Compensation Appeal Tribunal, as well as appeals to the Court of Appeal.


Duties will include:

  • Provide workers with general information about the Workers Compensation Act and Regulations and board policies and procedures, and advice on benefits they may be entitled to and actions they should take when the Board denies their claim;
  • Evaluate claims of workers to determine if they are receiving all benefits they are entitled to under the provisions of the Act;
  • Interview claimant and contact physicians, specialists, hospitals to obtain medical evidence or expert opinions in support of or to clarify the worker’s claim;
  • Negotiate claims on behalf of injured workers with WCB in an effort to gain approval of the claim;
  • Preparing Request for Internal Reconsideration submissions on behalf of workers;
  • Prepare comprehensive factums and present the client’s case to the Appeal Tribunal by leading and coordinating evidence, cross examination of witnesses, and arguing the interpretation and administration of the Act;
  • Prepare materials for the representation of workers before the Court of Appeal, and present admissible documents and written and oral arguments;
  • Provide research and advice to the Director regarding opportunities to improve management of the resources of the Office of the Worker Advisor to ensure it meets the program’s mission and objectives;
  • Develop and maintain a data management system to maintain accurate and essential client information;
  • Promote the Office of the Worker Advisor through communication materials and group presentations;
  • Other related duties as required.


Minimum Qualifications:

  • Successful completion of a law degree;
  • A member in good standing with the Law Society of PEI (or eligible to become a member within 45 days from appointment);
  • Experience in interpretation of Acts and Regulations (such as the Workers Compensation Act and Regulations, the Occupational Health and Safety Act and Regulations, etc.), legal and court procedures, administrative and common law principles;
  • Knowledge of Acts and Regulations (such as the Workers Compensation Act and Regulations, the Occupational Health and Safety Act and Regulations, etc.) and knowledge of medical terminology as it pertains to injuries;
  • Advocacy skills for presenting cases before administrative tribunals and courts;
  • Strong oral and written communication skills and interpersonal skills;
  • Excellent research and mediation skills;
  • Acceptable criminal records check and a vulnerable sector check.


Other Qualifications:

  • Bilingualism (French and English) will be considered an asset.
