The Opportunity

This position works out of our Alameda, CA location in the Abbott Diabetes Care Division. We’re focused on helping people with diabetes manage their health with life-changing products that provide accurate data to drive better-informed decisions. We’re revolutionizing the way people monitor their glucose levels with our new sensing technology.

As a member of the legal team supporting Abbott Diabetes Care, a CES 2022 Best of Innovation winner, the attorney will provide legal guidance to a fast paced, rapid-growth, patient-centric, and dynamic business unit across a variety of legal topics and geographies. The individual will collaborate with many aspects of the business, including: market access, payor contracting, reimbursement, marketing, sales, business development, customer service, purchasing, supply chain, clinical, regulatory, and quality, to provide top notch legal advice and drive positive outcomes for Abbott and the people who rely on its products.

This individual also will be an integrated part of a larger diverse Commercial Legal Operations team that works across Abbott divisions to build and grow successful relationships with business partners, outside attorneys and professionals, and customers.

This position reports to Senior Counsel, Abbott Diabetes Care.

What You’ll Work On

  • Participate in the preparation and negotiation of US and global business development partnerships, commercial contracts, and agreements with: diabetes management hardware and software companies, managed care organizations, pharmacy benefit managers, hospitals, GPOs, governmental entities, health care professionals, suppliers, and researchers.
  • Provide legal counsel to Abbott’s Diabetes Care US commercial team on reimbursement and data connectivity and interoperability issues.
  • Advise marketing and commercial teams on advertising and promotional practices, claims, social and digital media guidelines, engagement with influencers and celebrity endorsements, including with respect to Federal Trade Commission and other global regulations.
  • Provide risk management advice and legal support for the corporate incident response and customer service teams on global issues.
  • Provide legal counsel on compliance, risk management, and other legal issues in the context of federal and state regulatory requirements, including federal consumer protection laws, fraud and abuse laws, Anti-Kickback issues, Sunshine law, False Claims Act and Foreign Corrupt Practices Act.
  • Supervise and direct outside counsel as needed.
  • Work in close cooperation with Abbott’s compliance, intellectual property and privacy organizations to develop strong legal outcomes.
  • Identify training needs and assist in development and presentation of training and education regarding legal requirements and developments.
  • Develop understanding of and familiarity with: Abbott’s business, its people, products, markets, facilities, customers, and competitors, and use this knowledge in providing guidance and counsel to Abbott Diabetes Care.
  • Infrequent and minimal travel may be required (10-15%).

  • Collaboration: Firm understanding of available legal, functional, and business resources and ability to integrate information from several sources to achieve business results, including working across boundaries to create alignment as necessary, in a complex, global, matrixed environment.
  • Anticipation: Holistic, big picture thinker, who anticipates changes in law, enforcement, and/or business objectives and adapts approaches as necessary to manage risks effectively and mitigate issues before they arise.
  • Influencing Skills: Build strong relationships with business partners to tactfully influence and gain their support to drive appropriate risk-based successful outcomes. Represent Abbott externally to customers, suppliers, competitors, trade associations or government agencies; and resolve legal issues using negotiation skills and legal expertise/engage in external influencing efforts.

Required Qualifications

  • Possess a Juris Doctor degree from an accredited law school, demonstrate a strong academic background, and be admitted to a US state bar in good standing.
  • Five or more (5 ) years of experience as a commercial attorney at a top law firm and/or in-house, including the provision of legal advice on commercial matters and/or drafting/editing commercial contracts.
  • Ability to handle multiple projects in fast-paced environment and exercise sound commercial and legal judgment.
  • Strong process and analytical skills.
  • Excellent problem-solving ability.
  • Excellent time management skills and ability to manage competing priorities while ensuring timely completion and follow up.
  • Ability to work independently and prioritize multiple projects.
  • Must be adept at follow up and collaboration.
  • Dynamic, proactive and mature.

Preferred Qualifications

  • At least five (5) years of progressively more responsible work experience in the health care industry, at a top law firm, or in-house and working.
  • Experience working with on drafting and negotiating group purchasing organization agreements.
  • Experience with medical device reimbursement issues in the US and globally.
  • Experience with navigating federal trade commission issues in the US.
  • Experience representing an FDA-regulated company, including knowledge of federal consumer protection laws, fraud and abuse laws, Anti-Kickback law, AdvaMed Code, HIPAA, GDPR, and other laws and regulations pertaining to the global pharmaceutical or medical device industry.
  • Medical device, digital health, pharmaceutical or other health care business experience, and/or hospital/health system experience.
  • Demonstrated ability to understand and comply with applicable FDA regulations and company operating procedures, processes, policies, and tasks.
