This role is an attorney function within the Legal Marketing & Compliance Team, which is an integral pillar of the client-facing legal services under the leadership of the GVP, Chief Digital Technology and Innovation Counsel. The Legal Marketing & Compliance Counsel will report to the Senior Counsel, Legal Marketing & Compliance, and with the Senior Counsel, will supervise the work of two analyst members of the LMC Team. The position will have client-facing responsibility for the Company's legal needs in connection with the development and execution of its marketing of Albertsons’ programs, services and products. Business-oriented and pragmatic, the attorney will be proactive in his/her approach; concise, clear and unambiguous in his/her legal advice; and possess the ability to work autonomously as well as collaboratively. S/he will also be comfortable with and skilled in working within a small, but highly successful team and interacting with senior management. The successful candidate will be effective in moving between a hands-on, operations-focused view and a highly strategic outlook. The attorney will have a high degree of ethics and integrity; be creative, forward-thinking, and self-motivated; and have demonstrated strategic and conceptual thinking and collaborative, evaluative leadership in his/her prior roles.
Main responsibilities
- Partner closely with Product Development and Management, Technology & Engineering, Loyalty, Marketing, Compliance, Support and Operations teams and provide counsel and advice on a wide variety of complex and developing legal, regulatory and compliance issues in connection with the delivery of Albertson’s products.
- Advise on requirements affecting all stages of a product's life cycle, including design, development, loyalty programming, e-commerce requirements marketing, public relations, product launch and distribution, and related product regulatory concerns.
- Ensure compliance with U.S. laws and regulations and company policy dealing with marketing and advertising compliance, including TCPA, CAN-SPAM and FTC rules regarding misleading claims.
- Maintain current understanding of best practices related to legal issues in product development and marketing for technology companies, including strong familiarity with data analytics and monetization, digital marketing, including MarTech and AdTech, intellectual property and privacy matters.
- Develop and maintain required product legal resources, including self-help tools, terms of service, EULAs, EUSAs, privacy notices and other disclosures.
- Work closely with the business development and technical teams as counsel on strategic partnership/alliance deals as well as support inbound related transactions.
- Review, draft and advise on advertising and marketing materials, including press releases, packaging, product launch collateral, sweepstakes, promotions, and other related items.
- Serve as primary transactional counsel for a wide range of marketing-related contracts and related transactions, such as sponsorship agreements, marketing vendor service agreements and statements of work, social influencer and media personality agreements, marketing partnership, and Loyalty program execution agreements.
- Manage and supervise (along with the LMC Senior Counsel) a small team of legal analysts.
What we are searching for
- Juris Doctorate.
- 12 years of legal practice experience preferably combining law firm and in-house service.
- Significant experience with digital marketing, data monetization, MarTech and AdTech, drafting and negotiating complex technology agreements.
- Experience with intellectual property, licensing, privacy and marketing compliance law related to the technology sector.
- Proven success managing a team of attorneys.
- JD from an accredited law school and strong academic credentials
- In-house experience strongly preferred.
- Experience managing outside counsel and legal budgets preferred.
- Licensed to practice law and in good standing under the Bar of any state that enables admission to practice as in-house counsel.
- At least (10) years of experience, with emphasis on digital/technology law
