Job Summary:
Reporting to the Chief Compliance Officer this position has a breadth of responsibility that includes Ethics & Compliance for the Americas and Global Market Compliance.
As Director of Ethics & Compliance, Americas, this position is responsible for overseeing all business (Product groups and RCO) activities in North America (the “Region”) related to Ethics and Compliance. This includes all relevant laws and regulations pertaining to Anti-Bribery, Anti-Corruption, OFAC Compliance (import/export), Physician Payment Transparency, Anti-Slavery, Conflict Minerals, and all Dentsply Sirona Policies and Codes of Conduct.

As Global Market Compliance Officer, this position has responsibility for leading Dentsply Sirona’s (DS) compliance program related to all externally facing policies including, globally, how DS interacts with Healthcare Professionals (HCPs), Distributors, and Government Officials. Laws and regulations in scope of ownership are the Anti-Kickback Statute, False Claims Act, U.S. federal Sunshine Act, U.S. gift ban states, Loi Bertrand/French Anti-Gift law, German Health Care Anti-Corruption law, Global Transparency/Anti-corruption laws (currently 12 plus countries in scope with more on the near horizon). Key Policies in the scope of ownership are the Marketing to Professionals Code of Conduct, Open Payments Guideline, Grants/Sponsorship/Donation Policy, Business Gifts and Entertainment policy, Clinical Contest policy, and Educational Forum Guideline. Responsible for establishing and operationalizing procedures to promote compliance with the guidelines, policies, and laws.

Essential Duties:
General:
  • Proactively identifies, researches, and solves complex issues and advises SBU and RCO management and corporate leadership on needed actions to ensure compliance with local country and US legal requirements.
  • Provides strategic leadership throughout the organization by regularly reviewing and updating policies and procedures in light of the current legal landscape of the industry to ensure consistency and appropriateness
  • Maintains a public profile as a thought leader in Marketing Compliance by relevant associations and forums and speaking at conferences/seminars.
  • Maintains a high degree of expert knowledge in delivering educational workshops; reviewing professional publications; establishing personal networks; benchmarking state-of-the-art practices; participating in professional societies.
  • Develops a budget for its function and delivers within the budget.

Compliance & Ethics, North America:
  • Acts as the point of contact for questions on Ethics & Compliance policies and procedures in the Region.
  • Leads the Ethics & Compliance generalist (supports the department globally)
  • Reviews of new distributors and consultants’ due diligence and contracts
  • Oversight of ongoing monitoring efforts for the Region of their distributor network.
  • Monitors new legislation and assessment of changes required in Dentsply Sirona policy to assure compliance.
  • Risk assessment and monitoring; contribute to the development and implementation of a risk assessment process and implement across the Region.
  • Inventors existing policies and procedures addressing identified risk areas and identify gaps
  • Contributes to the development and execution of education and training programs as well as a rollout and communications plan addressing frequency, the issue of new employees, employees of acquired companies, and consequences of failure to complete required training
  • Monitors the Region’s compliance with Dentsply Sirona standards and procedures.
  • Utilizes the Convercent helpline system to report and initiate an investigation of any compliance-related issues.
  • Investigates and resolves complicated problems relating to compliance & ethics and as part of that serves as a panel member assigned to the resolution of employee hotline issues.
  • Develops and contributes to modifications of compliance program policies and procedures to reduce the likelihood that similar violations will occur and implement changes as necessary.

Global Marketing Compliance
  • Serves in a leadership role, and provides direction to the board, for the group’s strategy to achieving compliance with the Anti-kickback statute, False Claims Act, Global Transparency, U.S. state regulation
  • Oversees and leads all activities related to the development, implementation, maintenance of, and adherence to, the Marketing to Professionals Code of Conduct including all subordinate policies, and procedures.
  • Stays abreast of all evolving case law and OIG guidance related to AKS and FCA – particularly as pertaining to the Dental sector.
  • Performs and/or oversees risk assessments and conducts/oversees related to ongoing compliance monitoring activities.
  • Oversees, directs, delivers, or leads the delivery of initial and ongoing training to all employees, contractors, and other appropriate third parties related to DS policies pertaining to ethical interactions with HCPs, business partners, and government officials.
  • Chairs the Grants and Sponsorship Committee to assure that all donations to educational institutions and organizations comply with all global laws and regulations and align with the company’s strategic objectives.
  • Oversees the company’s global Transparency program (currently 12 plus countries with existing regulations with more on the horizon) including the implementation of a global platform to handle reporting requirements.
  • Owns the Budget for all global transparency matters including implementation projects and costs for a global platform
  • Leads the Global U.S. Transparency Analyst
  • Oversees compliance with U.S. state laws including those with the transparency reporting requirements, prohibitions, and gift bans and those with state-level Anti-Kick Back regulation (all-payor states).
  • Oversees compliance with global laws and regulations for all educational and training events where HCPs have been invited to participate.

Other Duties
  • Prepare status reports on projects and programs for Compliance and Ethics Committee meetings and Audit Committee presentations.
  • Participate in process improvement projects as necessary.
  • Ability to travel to other Dentsply Sirona locations, Dentsply Sirona meetings, and/ or conferences. May include multi-day/ overnight travel.
  • Performs other duties as assigned or as may be necessary

Education and/or Experience:
  • A Bachelor’s Degree from an accredited college or university is required; an Advanced degree in Legal Studies or JD Degree is desirable
  • Minimum of 10 years experience in a Compliance, Regulatory, or Auditing, or Legal function, with at least 4 years experience directly implementing and managing worldwide compliance and ethics programs.
  • Managerial experience is required.
  • Experience with Learning Management and/or Document Control Systems is highly preferred.
