Essential Functions: Manages and ensures the appropriate handling of litigated claims matters involving EMC. Ensures proper review, analyzes exposures, and assesses the overall potential of recovery in extra contractual claims and complex coverage claims handled by team. Analyzes coverage, determines liability, and extent of damages on assigned extra contractual claims as appropriate. In collaboration with outside counsel, proactively develops litigation strategies in complex coverage and extra-contractual claim files to drive appropriate indemnity outcomes. Ensures proper documentation of claim files. Selects and retains experienced counsel to represent EMC in complex coverage and extra-contractual matters. Evaluates work product of panel counsel and provides feedback to Claims teams as necessary. Collaborates with Claims teams to prevent or mitigate extra-contractual exposure Builds culture and develops team members while overseeing Corporate Office Claims Legal team. Develops team expertise and completes succession planning, including identifying talent and implementing development plans for critical positions. Fosters an innovative culture, including supporting new ideas and providing guidance on potential changes. Manages budgeted resources by anticipating expenditures, accurately forecasting resource needs/costs and properly accounting for expenses to meet requirements and achieve fiscal responsibility. Identifies and develops team members to effectively manage complex coverage and extra-contractual litigation. Serves as an expert resource on coverage and good faith claim handling issues for Claims Legal team, the claims department and leadership, and other impacted EMC teams and leaders. Facilitates timely and effective coverage and good faith claim handling advice and education to Claims teams to facilitate proper application of policy provisions, good faith claims handling, and provides cost effective management of coverage litigation. Participates in initiatives that support claims strategies and financial goals. Collaborates with Claims Legal team members to evaluate and coordinate the process of maintaining the company approved list of defense counsel for coverage and extra-contractual litigation. Interviews and selects outside counsel to represent EMC in coverage and extra-contractual litigation. Collaborates with other EMC Claims teams to ensure that outside coverage and extra-contractual counsel have the necessary expertise, geographical representation, and appropriate rate structure. Evaluates work product of panel coverage counsel and provides feedback regarding effectiveness of outside coverage counsel Education & Experience: Juris Doctorate with bar admission in at least one state Ten years of experience in insurance claims litigation in progressively responsible roles or related experience Coverage litigation experience preferred Pursuit of insurance designations desired Knowledge, Skills, & Abilities: Excellent knowledge of the theory and practice of the claim function as well as legal liability and coverage Superior knowledge of litigation management Excellent knowledge of insurance contracts, medical terminology and legal aspects of court procedures affecting legal liability for all lines of insurance Excellent leadership qualities Excellent knowledge of computers and claims systems Superior organizational and written and verbal communication skills Occasional travel; a valid driver’s license with an acceptable motor vehicle report per company standards required if driving Our employment practices are in accordance with the laws that prohibit discrimination due to race, color, creed, sex, sexual orientation, gender identity, genetic information, religion, age, national origin or ancestry, physical or mental disability, medical condition, veteran status, active military status, citizenship status, marital status or any other consideration made unlawful by federal, state, or local laws.
