POSITION OVERVIEW:
Plan, manage and control multi-national claims programs and the administration of general liability, automobile liability, subrogation and related third party tort litigation. Protect the company by mitigating the cost of liability claims and related expenses. Maintain current knowledge and ensure compliance of applicable laws, rules and regulations to include the evaluation of the impact of current, proposed and/or new laws, rules, and regulations within the United States, Canada, Mexico and Puerto Rico.
ESSENTIAL JOB DUTIES/RESPONSIBILITIES:
1. Plan, select, train, develop, motivate, lead and manage an in-house staff of claims professionals
2. Maintain responsibility and oversight for the response to High Profile incidents and crisis impacting the company
3. Manage litigated claims. Coordinate and consult with Legal counsel in lawsuits against the company including attending relevant court hearings, mediations, depositions and other travel as necessary
4. Develop, implement and manage effective and efficient processes and procedures for the administration and reporting of claims, associated litigation and related escheatment liability
5. Analyze liability claims data to identify trends; conduct strategic planning to control costs associated with claims and present data trends to leadership and cross-functional departments as applicable
6. Develop, implement and monitor the effectiveness of cost containment programs designed to control costs related to liability claims
7. Manage and control activities associated with a large commercial automobile and general liability claims portfolio including subrogation claims, both litigated and non-litigated, to ensure appropriate investigation, evaluation of coverage, determination of liability, evaluation of damages, reserving, defense and settlement strategies, identification of indemnification sources, settlements in serious claims and litigation with settlement authority up to $350,000 or as otherwise authorized by senior leadership
8. Ensure all claims and related matters are handled in accordance with legal obligations and in compliance with applicable laws, rules and regulations
9. Select, negotiate, facilitate contractual agreements and manage the performance of all liability claims administration and cost containment vendors
10. Develop, implement, manage and monitor the effectiveness of controls over reporting, audit tools, administration and payment of claims; respond to various internal and external audits of processes, procedures and controls
11. Comply with all applicable laws/regulations, as well as company policies/procedures
12. Perform other duties as required

QUALIFICATIONS:
• Bachelor’s Degree or equivalent work experience plus five (5) years of management experience leading a professional staff and managing a large portfolio of bodily injury and property damage liability claims, both litigated and non-litigated, of significant exposure and complexity involving serious injuries
• Commercial automobile liability and general liability claims experience required
• Legal experience and active bar membership preferred but not required
• Leadership/managerial experience and interpersonal skills necessary to lead a team of liability claims professionals
• Comprehensive knowledge of casualty claims, contract, tort, damages, subrogation, contribution/indemnity and other applicable / related law for the United States, Canada, Mexico and Puerto Rico
• Comprehensive knowledge of insurance policy provisions, practices, laws and regulations
• Ability to interpret and apply laws and regulations, determine appropriate courses of action, present solutions and resolve claims
• Strong verbal and written communication skills including presentation skills and public speaking
• Excellent analytical, problem solving, negotiation, vendor selection, contracting and organization skills
• Strong knowledge of statistical claims data and reporting
• Professional designation in claims and/or insurance preferred
• Experience and ability to use Microsoft Office Software, including but not limited to; Word, Excel, and Outlook
WORKING CONDITIONS:
• Must be able to travel
