Summary of the Position: The Senior Manager, Contracts & Procurement (Government) will support a global contracting and procurement function for a small, but quickly growing CRO start-up. They will provide considerable support to the process of defining and improving standardization/streamlining of operations and enhancing the value of the company. This position is responsible for leading the drafting, negotiation, review & approval, and execution of contracts with FHI Clinical's US Government customers, associated vendors and strategic partners. Reporting to the Global Head, Contracts & Legal Affairs, the candidate will work closely with executive and senior management across the enterprise to support sponsored projects and internal requirements. The Sr. Manager will lead the review process for simple to complex contractual arrangements and support large strategic projects and corporate initiatives. The successful candidate will provide guidance and mentoring to other members of the Contracts & Procurement team as required. Essential Functions: Responsible for managing the relationships between FHI Clinical and its USG customers and/or Prime Contractors, and related vendors for an assigned portfolio of simple to intermediate complexity. Responsible for the drafting, reviewing, negotiating, finalizing, and managing agreements with third parties (sponsors & vendors) including, but not limited to: Confidentiality agreements, consulting agreements, master services agreements, clinical trial agreements, statements of work, change orders, task orders, and data privacy and information security agreements with limited support, as needed, from department management. The Senior Manager will also manage the execution of other less frequently encountered third-party and multi-party agreements. Follow established department processes for efficient and transparent management of company business. Perform duties in compliance with company processes & policies. Lead policy/ process development on an ad hoc basis. Interact with various internal clients and functional groups to identify and address legal and business questions and provide guidance as well as practical solutions. Identify risks and develop risk mitigation strategies that department leadership will address with the senior leadership team. As a valued business partner, independently advise operations staff, finance partners, and other stakeholders at all levels regarding contract terms and conditions, applicable policies and procedures, and best practices to advance FHI Clinical's business objectives. Sound business judgment is required; escalation of troublesome or unfamiliar contract/legal questions to the Associate Director or Director as appropriate. Mentor, coach, and develop more junior talent; provide peer-to-peer guidance and support to other members of the CONPROC team. This position may be eligible for line management responsibility. Knowledge, Skills and Abilities: In-depth knowledge of the Federal Acquisition Regulation and its supplements (HHSAR), with a working knowledge of budgeting/pricing methodologies/concepts and indirect rates. Extensive experience drafting, reviewing, and negotiating a wide range of agreements in support of US Government programs of multiple contract types (CPFF, TM, FFP, etc.). Ability to review, analyze, assess risk, and summarize findings for standard and non-standard contractual agreements. Knowledge of general corporate business practices, commercial contracting regulations and principles, and subcontracting / vendor management practices. Advanced negotiation skills and understanding of the negotiation process. Solid understanding of information systems. Familiarity with Salesforce CRM, DocuSign, Costpoint, SharePoint & Kissflow preferred. Working knowledge of relevant business systems needed to support contract and procurement management activities. Ability to meet business-driven deadlines and commitments while maintaining a high level of quality and professionalism. Extensive experience drafting, reviewing and negotiating a wide range of commercial or US government agreements in support of CRO operations. Ability to review, analyze, assess risk and summarize findings for standard contractual agreements. Familiarity with clinical trial agreements/site contracts in support of clinical studies is considered a plus. Knowledge of general corporate business practices, commercial contracting regulations and principles, and subcontracting / vendor management practices. Position Requirements: Education: Bachelors’ degree required; Masters or Professional Degree preferred, such as MBA, J.D., or the international equivalent. Preferred Job-Related Experience: 5-7 years of experience required, with a minimum of five years as a US Government Contracting Officer or as a contract manager/administrator for the prime contractor, preferably on HHS or NIH funded programs. 2 years of experience in line management and oversight roles. Preferences: Any training specific to the role, such as contract negotiation, process improvement, or other. Knowledge of PMBOK / CMBOK principles is a plus. Relevant industry certifications: PMP, CPCM, CFCM, etc. Familiarity with Microsoft Office 365 suite of products.
