Responsibilities

MaxLinear is seeking a Director of Global Trade Compliance to join our growing team. In this role, you will focus on the following:

  • Support the MaxLinear Legal and Compliance Department through oversight and management of the global trade component of MaxLinear’s compliance program, to ensure the Company is in compliance with all applicable laws and regulations, including U.S., Taiwan and Singapore export control laws and regulations
  • Ensure the effective operation of MaxLinear’s global trade compliance program, including implementing policies, procedures, and systems strategy in accordance with applicable laws, regulations, the Company’s Code of Ethics and Employee Conduct, and Legal and Compliance Department priorities
  • Ensure global trade compliance processes and procedures are aligned with best practices and adhere to external regulatory developments and changes as well as internally driven business changes
  • Evaluate operational processes to identify gaps based on areas of potential compliance risks and collaborate with key stakeholders to develop and adopt corrective actions, remedial measures or other mitigation
  • Oversee and manage export compliance contractors and managed service providers, as applicable
  • Train employees on U.S. export controls laws and regulations as well as other applicable foreign trade laws and regulations
  • Manage and maintain relevant export classification information (screening and resolution, ECCN, and HTS determinations) while ensuring all new products are correctly classified
  • Prepare, review, and submit Commodity Classification Application Tracking System (CCATS) requests and related periodic reporting, encryption notifications, and similar applicable regulatory reporting or notification requirements
  • Determine applicability of Foreign Direct Product rule and calculate De Minimis for products to determine jurisdiction
  • Conduct manual Denied Party Screening (DPS), resolve potential DPS matches and block restricted parties from transactions
  • Collaborate with and support the Sales function to ensure compliance with applicable global trade regulations in the sales process, including in connection with Non-Disclosure Agreements and other contracts
  • Collaborate with and support the Company’s shipping and logistics function to ensure compliance with applicable global trade regulations, including by providing classification and shipping support
  • Develop business requirements and support the implementation of a Global Trade Management (GTM) solution, provide oversight and management of GTM solution post implementation
  • Develop and deliver specialized training on particular trade compliance issues and/or processes to employees at all levels across the organization
  • Partner with internal stakeholders to provide operational input on strategic business initiatives, programs and other key projects
  • Prepare, review, and submit export and deemed export license applications, oversee export license projects, and submit annual deemed export license reports
  • Prepare, review, and submit annual and semi-annual encryption reports to the U.S. Department of Commerce, Bureau of Industry and Security (BIS)
  • Ensure compliance with other applicable recordkeeping and reporting requirements
  • Ensure continuous improvement of global trade compliance function, conduct and support performance of compliance risk assessments, monitor and/or audit effectiveness of compliance processes, recommend and implement enhancements to global trade compliance program
  • Provide global trade and export compliance leadership for corporate projects and business initiatives
  • Exercise sound judgement within established guidelines
  • Assist MaxLinear’s Legal Department in providing legal advice to the business on global trade compliance and related issues
  • Assist MaxLinear’s Legal Department and the business with internal and external inquiries, investigations, and communications, including with customers and regulatory agencies (e.g., BIS)
  • Adhere to MaxLinear’s Code of Ethics and Employee Conduct and other corporate policies and procedures

Qualifications

  • Strong operational understanding of global trade compliance issues, including deep experience and comprehensive knowledge of import and export trade laws and regulations, including at a minimum, the Export Administration Regulations (EAR) of the U.S. Department of Commerce, Bureau of Industry and Security, regulations of the U.S. Treasury Department Office of Foreign Assets Control (OFAC), Singapore Strategic Trade Controls and the Taiwan Bureau of Foreign Trade (BOFT) regulations
  • Exceptional fluency with subject matter, a high degree of adaptability and the ability to anticipate and respond to changing regulatory and/or business priorities
  • Experience in developing global trade compliance programs, including implementing and updating compliance policies, procedures, manuals, and other operational documentation
  • Experience with the Harmonized Tariff Schedule (HTS) and Customs Rulings
  • Experience using SNAP-R and other systems used in connection with compliance with U.S. export control regulations
  • Experience with Denied Party Screening solutions, such as Visual Compliance
  • Experience analyzing jurisdiction and classifying high-tech commodities and software for export under the EAR, experience with information security (encryption) controls under the EAR and related regulatory requirements
  • Collaborative with ability to effectively drive trade compliance operations at all levels
  • Strong critical thinking and project management skills, attention to detail, ability to exercise independent judgment, manage complexity, and ability to work effectively under pressure
  • Excellent written and oral communication skills
  • Experience with the following preferred:
    • Semiconductor industry experience
    • Import experience
    • Deep knowledge of the export control regimes in EU and Asia
  • Bachelor’s degree 11 years of experience or Masters  9 years of experience

Compensation and Benefits

MaxLinear has a Total Compensation philosophy which includes base salary and annual discretionary bonus eligibility and many positions also include stock-based compensation.

 

MaxLinear expects to offer a starting base salary within the range of:  $157,600 to $244,720 Annually

 

We offer competitive benefits designed to support employee health, welfare, and retirement and some highlights are:  health care benefits, 401k savings plan, Employee Stock Purchase Plan (ESPP), paid time off, and a hybrid work schedule.

 

The actual starting base salary will be determined by the match to certain role-related criteria such as educational degree(s) or equivalent, relevant work experience, skillset needed for the role, and geographic location; this is not an all-inclusive list as some roles may require unique skills or experience.
