What are the responsibilities and job description for the Legal Counsel position at Santander US?
Santander’s Legal Department assists the bank in identifying, evaluating, and mitigating legal and compliance risks. The department is also responsible for support related to regulatory compliance and risk matters for Santander Bank, N.A. and Santander U.S. As part of Santander’s Legal team, you’ll help provide customized solutions and high quality, cost effective legal services to support Santander’s goals and objectives while ensuring compliance with relevant laws and regulations. Familiarity with requirements under the ADA, ECOA (Regulation B), EFTA (Regulation E), SCRA, FCRA , TILA, RESPA (Regulation Z), GLBA, and regulatory expectations regarding UDAP and UDAAP are preferred.
Applicants should have extensive experience in database architecture, with a solid understanding of data mining techniques.
Responsibilities -
- Work closely with the Senior Legal Counsel and other department attorneys to provide legal and risk analysis and support with respect to potential legal, regulatory, and reputational concerns arising from customer complaints concerning Santander Bank’s various products and business lines.
- Partner with the Santander Executive Office in reviewing, responding to and providing recommended course of action and advice related to the resolution of customer complaints
- Collaborate with compliance colleagues on regulatory concerns arising from complaints; and assist with regulatory examinations where complaint data is requested.
- Identify and escalate issues related to potential gaps in existing business processes, procedures, and review Bank policies and procedures as they relate to complaint matters at Santander Bank.
- Support the Senior Legal Counsel and others on complaints related matters, compliance and regulatory research, complaints and department tracking and reporting and other miscellaneous projects, as assigned.
- Work with the Santander Executive Office members to develop policy and procedure improvements related to complaints management at Santander Bank – including complaint intake and investigation strategy.
- Keep apprised of changes in law and regulations for complaint related compliance matters under Dodd Frank, Consumer Financial Protection Bureau, Federal Reserve Bank, FDIC and Office of the Comptroller of the Currency regulations.
- Support Regulatory Operations legal team members with respect to providing legal advice on regulatory compliance matters with an emphasis on bank regulatory issues including Reg Change Management, Privacy, CRA, Reg W, Reg O, BSA/AML, OFAC, heightened standards, whistleblower/ethics issues and new products.
- Collaborate with the Deputy General Counsel on regulatory/compliance matters.
- Bachelors or equivalent; Juris Doctorate or equivalent from an accredited institution
- At least 5 years of experience practicing in a law firm or in-house corporate environment in banking or the financial services industry.
- Current license to practice law in a state within the Bank’s footprint
- Microsoft Office (Outlook, Word, Excel & PowerPoint), Share Point
- Ability to deal effectively with the legal colleagues and executive management
- Strong organizational and prioritization skills; ability to manage competing priorities effectively
- Proven ability to meet stringent deadlines and adapt to changing priorities, operating in a fast-paced and dynamic environment.
- Excellence in drafting; ability to present information in written and oral form clearly and effectively
- Ability to define problems and collect relevant information and apply relevant legal principles to relevant factual situations
- Excellent communication and interpersonal skills.
