    Job Description Summary

    The Tribal Court Clerk provides administrative and technical support to the courts by receiving, preparing and processing documents; maintaining databases and files/records; collects and receipts Court fees and fines; and performs other related duties as assigned. This individual will be expected to handle highly confidential information in a professional and courteous manner.

    Essential Duties and Information (other duties may be assigned)

    • Reviews legal documents for accuracy and completeness and ensures documentation submitted for filing is timely, and in compliance with court procedures and legal requirements.
    • Creates, enters and maintains case files both electronic and manual case management systems.
    • Answers incoming calls and provides customer service at the front counter and via telephone; answers questions and provides information to the public regarding the policies and procedures of the court; case status, scheduling of court proceedings ensuring that information given is not legal advice.
    • Accepts, marks, and maintains exhibits according to established procedures.
    • Collect fines, fees and other monies imposed or charged by the Tribal Court, deposit such monies into the proper account of the Tribal Court, and account for the receipt and deposit of such monies utilizing court and accounting procedures.
    • Serves as a courtroom clerk for court cases and proceedings; attends court sessions and records and transcribes minutes of actions and proceedings, and prepares official records of court proceedings.
    • Schedules court proceedings and prepares proper notices to appropriate parties.
    • Prepares and types a variety of documents including general correspondence, notices, court orders, forms, records, and reports.
    • Prepares, processes, and certifies copies of court documents and files.
    • Enters and maintains data in automated case management system.
    • Maintains accurate and complete digital and physical file assuring all records are secure and retrievable; maintain an index of all cases filed with the Tribal Court by name and by case number.
    • Receive, sort and distribute incoming and outgoing correspondence.
    • Maintains absolute confidentiality of work-related issues, customer records and restricted court information.
    • Ensure case files are prepared, complete, up-to-date, and available for scheduled hearings.
    • Calls court to order in the absence of the Bailiff; administering oath and processing of documents.
    • Operates a computer to enter, update, correct, and access case information; and to produce computer generated forms and reports.
    • Operates courtroom audio and visual equipment to ensure proceedings are properly recorded and available for online streaming, when applicable.
    • Keep and maintain books of record, tape recordings of court sessions required by law or rule of the Tribal Court.
    • Assist with the maintenance of the list of attorneys admitted to practice in the Tribal Court.
    • Assists with the maintenance of procedure manuals.
    • Assist with the development of court forms, templates and processes.
    • Assist with preparing the courtroom for the proper conduct of hearings and meetings.
    • Assist with preparing the conference rooms for meetings and trainings.
    • Assist with the purchasing and maintenance of office supplies.
    • Assists with training when needed.
    • Attend Tribal Justice training events when requested.
    • Must have current status as a Notary Public or the ability to obtain and maintain a Notary Commission within (180) days of hire.
    • Represents the Tribe with dignity, integrity, and a spirit of cooperation in all relationships with staff and the public.
    • Perform other job-related duties and responsibilities related to the operation of the Tribal Court as required.

    Qualifications


    Education and/or Experience

    • Associate’s Degree from an accredited College or University in court administration, criminal justice, public or business administration, or paralegal and two (2) years of court or legal experience. Tribal court clerk experience, is preferred.
    • Knowledge of court procedures and services.
    • Knowledge of clerical and automated court case management systems.
    • Knowledge of modern office practices and procedures, and equipment.
    • Knowledge of legal terminology and Business English.
    • Ability to understand, interpret, explain and apply tribal policies, rules and procedures.
    • Ability to communicate effectively orally and in writing and maintain confidentiality of court matters.
    • Ability to maintain effective working relationships with employees, Community Officials, other agencies, and the public.
    • Ability to follow written and verbal instructions.
    • Ability to pass a background check.
    • Shall abide by the Code of Ethics for Judicial Employees.
    • An understanding of current Native American culture and experience working with Native American communities is preferred.
    • Must possess a valid CA Driver’s License.

    Working Conditions/Physical Demands

    To perform this job successfully, the individual must be able to stand, move and work throughout the office area and properties, including walking up to 1 mile, climbing stairs and sitting at a desk/work station for the duration of the shift.

    Typically, the individual will be housed in an office environment. The noise level in the work environment is usually moderate, but will escalate when located in the casino environment. Must be able to grasp, bend, lift and/or carry or otherwise move goods weighing a minimum of 25 lbs. on an intermittent basis, and sufficient dexterity of hand in order to use office equipment including, but not limited to: a computer keyboard, calculator, general office equipment and multi-line telephone.
