Privacy Director directs and develops the organization's privacy strategy, including policies, procedures, and initiatives. Ensures all business and data management processes reflect privacy requirements and comply with laws and regulations. Additionally, Privacy Director ensures that compliance monitoring, auditing, and remediation are effective.     Opportunity

    Provide sound and effective strategic business solutions through proactive and timely legal advice on data privacy and security. Partner with business and enterprise leaders, marketing teams, new product development and internal and external counsel to develop strategic data governance, ethics, and utilization principles. Actively manage a team of legal and technical personnel, with a focus on driving positive team engagement and culture.  Seen as lead subject matter expert on Data Privacy, Cybersecurity, and Medical/Biometric data collection laws and regulations, and strategic leader among the team.  Driving the business and marketing initiatives through privacy-minded approach.

    Specific Responsibilities

    • Provide legal counsel and guidance with a focus on effective problem solving and solutions orientation before a problem occurs.
    • Research, identify, and evaluate risk factors and legal issues that could impact operations or business objectives. 
    • Apply effective risk management techniques and offer proactive strategic advice on legal issues.
    • Guide leaders in the organization through effective partnership, education, and influence. 
    • Influence key business decisions and strategies through proactive identification of business opportunities and prioritizing key solutions to implement various financial and strategic plans. 
    • Provide leadership through being a champion for talent and engagement within the legal team as well as broader organization. 
    • Drive continuous organizational improvement by seeking ways to impact the end consumer, prioritize, and innovate with enforcing compliance and business ethics. 

    Data Privacy Responsibilities

    • Serve as Kohler Co.’s global Legal Data Protection Officer and HIPPA Privacy Officer, overseeing and managing Kohler’s data privacy program, to drive privacy program framework throughout the organization that includes drafting policies, standards, training, communications, monitoring, and management.
    • Partner with the business units to identify areas which may be vulnerable to data privacy risk and work cross functionally to implement solutions in leveraging privacy and security by design and data minimization principles for a market competitive edge.
    • Work with key internal stakeholders (ex. Cybersecurity) to design policies to achieve compliance, review proposed projects which involve the collection or utilization of personal data, advise on privacy risks and compliance with local data privacy laws. Where necessary, carry out privacy impact assessments.
    • Implement and maintain measures to ensure as laws evolve there is a streamlined reconciliation of those regulations with Kohler’s current global privacy framework.
    • Report to senior level executives within the organization, including where appropriate Board members, on data privacy program status, incidents, noncompliance, and regulatory reporting obligations
    • Develop transformative data utilization strategies for a privacy-focused individually customized end-user experience.
    • Develop and institute data ethics principles company wide.
    • Ensure Privacy by Design and By Default are implemented on the new projects, vendor onboarding, and system enhancements.
    • Support complex, strategic commercial transactions involving data protection terms, including reviewing, and negotiating with M&A third parties, customers, distributors, and vendor.
    • Conduct or oversee internal investigations and direct data privacy/cyber security incident response efforts.
    • Oversight of Data Subject Requests, data inventories, data mapping and other regulatory data record requirements
    • Support in negotiation of privacy, information security and compliance terms in technology, vendor, and service provider contracts involving the transfer of personal data.
    • Implement and maintain tiered service level model from Centers of Excellences (COE), and regional support model for optimized organizational support.

    Skills/Requirements

    • Four-year undergraduate college education resulting in an award of Bachelor of Arts or Science degree.
    • Three years of law school leading to the award of an L.L.B. or J.D. degree, or Masters or Doctorate in Privacy, preferred.
    • Minimum of ten years’ applicable experience with a private firm or corporate privacy function.
    • Extensive data privacy experience (minimum of 5 years preferred) in advising on US and International data privacy laws.
    • Experience of designing, maintaining, and developing data privacy compliance programs for large international organizations, preferably with some experience gained from an in-house position.
    • Experience working with global, cross-functional teams including both business and IT leaders as well as legal professionals.
    • CIPP certification US, E, or A required.
    • Previous leadership with proven ability to impact engagement, culture and results required.

    . The specific salary offered to a candidate may be influenced by a variety of factors including the candidate’s experience, their education, and the work location. In addition, this position is eligible for a performance bonus/variable incentive compensation. Available benefits include medical, dental, vision & 401k.
