Right of Way Agent prepares organization's need for additional land or office space. Researches, negotiates and elects to purchase short- and long-term lease of land agreements and right of way for construction that meet the organization's goals. Being a Right of Way Agent handles all land related legal issues, including transfers of titles and deeds, construction, mortgage concerns, and zoning. Prepares resolutions and other legal forms related to land acquisitions. Additionally, Right of Way Agent may require a bachelor's degree. Typically reports to a supervisor or manager. The Right of Way Agent contributes to moderately complex aspects of a project. Work is generally independent and collaborative in nature.     The Senior Right of Way (ROW) Agent will complete all functions of a right of way agent to ensure successful negotiation and land acquisition of private property for public use under the Federal Uniform Act, as well as communicate directly with agency or prime consultant management on status reporting, acquisition and/or relocation strategies, cost and schedule issues, and other property management or project functions.

    Primary Responsibilities:

    • Delegates to, works with, and educates/trains junior agents as needed
    • Direct communication with agency or prime consultant management on status reporting, relocation strategies, cost and schedule issues, and other project management functions
    • Acquires real property under the Federal Uniform Act
    • Performs title research and clearance associated with the acquisition process; advanced property and ownership research; and facilitates payments and escrow functions
    • Utilizes understanding of real property appraisals to transparently explain project, documents, processes, ROW plans, and property valuation to owners and/or tenants
    • Prepares administrative settlements and justifications and develops mitigation plans
    • Facilitates the relocation of property owners and their tenants, including commercial businesses, residential owners and occupants, personal property, farms, etc., dependent on scope of work
    • Manages real property acquired for a public entity
    • Reviews acquisition files to ensure there are no outstanding real property issues
    • Acquires knowledge of the statutory authorities and the client’s specific rules and regulations
    • Other duties as assigned

    Requirements

    • Five or more years demonstrated successful negotiation experience in the right of way profession
    • Current Real Estate and Notary Public licenses in Washington
    • Valid Washington driver’s license and an acceptable record
    • Ability to work independently and remotely in various locations inspecting buildings and land, travel throughout the state and the Pacific Northwest, and sit or stand for long periods of time
    • Acquisition experience under the Federal Uniform Act
    • Strong working knowledge and understanding of right-of-way laws and regulations, including but not limited to state transportation department ROW manuals and the Uniform Relocation Assistance and Real Property Acquisitions Policies Act of 1970 as amended
    • Strong working knowledge of property legal descriptions, title reports, and instruments of ownership
    • Strong working knowledge of the connectivity of real estate disciplines (e.g., acquisition, relocation, property management, title, project management, appraisal, etc.)
    • Must demonstrate strong oral and written communication skills, show a high degree of professionalism, and be resourceful and proactive in dealing with obstacles that arise
    • Demonstrated ability to draft administrative settlements and mitigation plans
    • Proficiency with personal computers, Microsoft Office Suite, Google Earth, ArcGIS and data management software
    • Must be well-organized and detail-oriented
    • Ability to prioritize and complete assignments accurately and in a timely manner
    • May require after-hours and weekend work
    • Must be able to pass a criminal background check
    • Maintain confidential nature of communications

    Preferred Skills and Education

    • Bachelor’s degree in a related field
    • Proficiency with Mac computers
    • Approved consultant for WSDOT ROW Services or ability to complete approval process within one year of hire (acquisition, relocation, relocation review, title, property management)
    • Multilingual

    Benefits

    • Commonstreet offers a medical/vision and dental plan for the employee and all immediate family members that is 100% paid by the company. Should you elect, the plan also includes a Health Savings Account (HSA) to which the company will contribute $1,500 on the 1st of the month following 60 days from benefits start date and again annually on this date.

    • Commonstreet’s 401(k) plan provides a match of 100% of deferrals up to 3% of compensation and then 50% of deferrals on 3% to 5% of compensation. All contributions are fully vested.
    • Full-time employees will accrue 117 hours of PTO per year, for the first 3 years. Accrual of this time is spread out evenly by paycheck and comes out to 4.5 hours per pay period. 
    • 8 paid holidays
