Salary.com Compensation and Pay Equity Law Review

Welcome to Salary.com's Compensation and Pay Equity Law Review.

Our editor, employment lawyer Heather Bussing, is tracking legislation, cases, and analysis to give you the latest critical HR topics. She and Kent Plunkett, CEO of Salary.com, also have a new book out on Pay Equity, Get Pay Right: How to Achieve Pay Equity that Works!

This week we're asking these questions and even answering some of them:

  • What, if anything, did the disparate impact EO change?
  • Why is it essential to stay on top of unused vacation time?
  • How can employers hire foreign nationals beside the visa lottery?
  • Why does pay transparency matter?
  • How should employers approach employee mental health issues?

I'm not sure what the disparate impact EO is really about. But it doesn't change the law. Here's a great explanation from Robin Shea at Constangy and a few thoughts of mine of AI.

It's Vacation Time

Vacation time can be a huge liability for employers. That also means employees aren't taking vacation. Here's some great vacation policy advice.

The Fisher Phillips team has created a great resource for understanding the options for hiring foreign national workers. This is especially important for tech and other industries that rely heavily on the ability to hire people to do work in the US.In the current climate, it may still be difficult to get people to come to the United States right now.

The point of pay transparency is that it helps everyone understand what they're getting into and assures everyone that it's fair. Sure, there's legal stuff to consider. But it's the practical stuff that really matters.

Mental Health is Health

The most important thing for employers to understand is that mental health issues are not the employee's fault. Having depression, complex trauma, or any of the many other conditions that arise is no different that catching Covid, breaking your arm, or getting a cancer diagnosis. Our bodies, brains, and emotions all have limits on what they can handle. This is part of being human.
