What are the responsibilities and job description for the Bankruptcy Specialist (Hybrid) position at Atlantic Union Bank?
The Bankruptcy Specialist will be responsible for coordinating the activities of the Bankruptcy Team. Including, but not limited to, communicating with attorneys, U.S. Bankruptcy officials, customers and various departments within the Bank. The Bankruptcy Rep will handle multiple tasks and deadlines that require attention to detail and strong organizational skills. This position will be responsible for handling a portfolio of loans in bankruptcy in accordance with state, government agency and Bankruptcy Code Guidelines. Success in this position will result from mitigation of exposure to loan loss and legal risk. This position will generally serve as the primary point of contact within the Bank for consumer, and some business-purpose, bankruptcy cases. The Bankruptcy Specialist will process incoming notices of bankruptcy and monitor cases throughout the lifecycle of the bankruptcy case. This may include, but is not limited to the following:
Position Accountabilities
- Receive and review bankruptcy notices.
- Update and document the Bank’s loan systems to reflect new bankruptcy cases as well as update the status of the bankruptcy cases to include dismissal, discharge and case closure.
- Manage detailed bankruptcy case files including: routine monitoring, updates to case status, calendaring key dates such as 341 hearings and deadlines for filing claims, and determination of the Bank’s interest in the proceeding.
- File, amend, or withdraw claims on behalf of the Bank.
- Review and analyze plans of reorganization and statements of intention.
- Research and respond to requests received from Trustees or debtor’s attorneys.
- Obtain and document reaffirmation agreements.
- Post, reconcile and verify proper allocation of payments on Chapter 13 (pre and post-petition) and Chapter 7 cases. May assist with certain Chapter 11 and 12 cases from time to time.
- Follow up on court-stipulated payment and forbearance plans.
- Send delinquency letters as required.
- Assist with the preparation of motions for relief, objection to plans, invoicing, etc.
- Follow up with collection of reaffirmed or dismissed cases.
- Adhere to court-appointed timelines.
- Monitor any senior lien holder for possible stay relief or foreclosure.
- Fulfill internal reporting requirements.
- Maintain prompt, efficient, confidential and professional service to customers, teammates and management.
- Perform public records research for information about a debtor's financial status, including real estate records and prior judgments.
- Comply with all applicable federal and state laws and regulations.
- Additional responsibilities may be assigned.
- Train and mentor new and existing Collection Specialists involved in administering bankruptcies.

Position Qualifications
Education & Experience
- High School diploma or equivalent.
- Minimum of 7 years relevant work experience. Preference is given to prior Bank experience.
- 2-year college degree, a paralegal certificate, or similar post-secondary certification is desired but not required.
- Experience managing personnel is desired but not required.
Knowledge & Skills
- General knowledge of office software (e.g. Excel, Word).
- Knowledge of bankruptcy laws/regulations and practices.
- General knowledge of regulatory rules that apply to communication with customers such as the FDCPA, RESPA, FCRA, etc.
- Strong knowledge of PACER and U.S. Courts website.
- Strong attention to detail is essential.
- Ability to work independently with a minimum of supervision and exercise sound judgment.
- Ability to write reports, memorandums, business correspondence and draft procedure manuals.
- Ability to effectively present information and respond to questions from managers, clients, customers, and the general public clearly and concisely.
- Must be proficient with numbers and basic accounting.
- Experience creating bankruptcy procedures is desired but not required.
Special Requirements
- Driver’s license and reliable transportation. Able to travel to Courts, office, meetings and training sessions.
- Notary Public designation is desired but not required.
- Works hours as scheduled including overtime and weekend hours when needed.
Salary offered will be based on several factors including but not limited to education, work experience, certifications, etc. This position is also eligible to participate in either an applicable incentive compensation plan for the position or a discretionary profit sharing bonus program.
