Position Summary:

The incumbent will ensure BMS Enterprise export compliance operations meet global federal guidelines and adhere to regulations, including those related to export controls, denied parties, and embargoed countries, in markets where BMS is the exporter.

Develop and implement consistent export compliance strategies across global locations where BMS is the exporter.

Oversee and serve as SME on export transactions escalated to the Corporate Customs & Trade Compliance organization for proper invoice practices, ECCN/Licensing Requirements, denied parties, embargoed countries, and more.

Business Process owner and SME for SAP/GTS Restricted Party Screening.

Demonstrate commitment to excellence, integrity, and willingness to take ownership and accountability for results.

Responsibilities

  • Develop a strong strategy and management plan for Export compliance at BMS across Americas/LatAm/EMEAI/APAC regions for all business units
  • Collaborate with BMS regions to implement a global approach to export compliance and identify opportunities to standardize processes, reduce the risk of noncompliance and implement a scalable program.
  • Develop and implement corporate policies, directives, procedures, and processes for managing Export compliance.
  • Drive the delivery and communication plans for assigning and training on respective procedures.
  • Advise BMS business units regarding sanctions and restricted party compliance by providing training on when and how to conduct training and enforce BMS’ overriding principals.
  • Provide guidance and direction as needed on Export Compliance Laws and Regulations, including, but not limited to
    • The assignment of Export Control Classification Numbers (ECCN) and Harmonized Tariff Schedule (HTS) Numbers for exports
    • Promptly and accurately resolving customer shipment problems.
    • Export Administration Regulations (EAR)
    • EU Dual use/Sanctions Regulations
    • Foreign Trade Regulations (FTR)
    • Office of Foreign Assets Control (OFAC)
    • International Traffic in Arms Regulations (ITAR)
    • US Customs and Border Protection (CBP)
  • Evaluate exports for license Requirements
  • Facilitate site self-assessment programs (i.e., C-TPAT/AEO) as required
  • Aid in preparation for Export Compliance related audits and directly facilitate audits as the primary point of contact
  • Remain current on Export Laws and Regulations and work with sites and other stakeholders to determine business changes required to address new regulations or changes to regulations
  • Provide support or leadership to other company wide projects or initiatives, as necessary.
  • Support continuous improvement and opportunities for automation

Required Competencies

  • Project Management
  • Ability to work independently
  • Extensive knowledge of the following areas:
    • US customs regulations preferably with products under FDA authority
    • Product HTS and ECCN classifications, valuation, and Country of Origin determinations for pharmaceutical products
    • Other Export Licensing regulations and processes – for example, EU, UK, & CH
    • Automated Commercial Environment (ACE) and Import Trade Auxiliary Communications System (ITACS)
    • Government regulations
    • Regulatory & Compliance functions

Required Qualifications and desired experience

  • Undergraduate degree in Business, Finance, Supply Chain or International Trade, preferred.  MBA degree a plus
  • A minimum of 7-10 years in Supply Chain/Finance/Logistics experience in a bio-pharmaceutical company, which includes at least 5-7 years in a Trade Compliance role
  • Expertise of Export regulations
  • Knowledge Export Controls, Sanctions, Anti-boycott and Restricted Party Screening regulations
  • Understanding of global biologics manufacturing, logistics and distribution operations
  • Knowledge of export practices by specific region
  • Knowledge and experience in conducting Export audits
