What are the responsibilities and job description for the Court Commissioner position at Brown County?

The purpose of this position is to decide contested matters, administer the court system, and provide services for the timely handling of cases to the benefit of the public, judges and the bar.

Anticipated Start Date in February 2024
Presides over initial appearances in criminal and criminal traffic cases; establishes and reviews bail, assesses sufficiency of criminal complaints and conducts indigence hearings.
 
Conducts probable cause hearings in felony criminal cases and involuntary mental health commitment cases.
 
Conducts initial appearances in traffic, ordinance violation, and Department of Natural Resources cases, and disposes of uncontested matters.
 
Presides over domestic abuse and harassment injunction hearings and issues injunctions and firearms surrender orders as appropriate.
 
Presides over initial appearances in juvenile court matters; establishes and reviews temporary custody orders.
 
Presides over preliminary proceedings and conducts post-judgment hearings in family law and paternity cases; enters orders with respect to legal custody and physical placement of children, child support, maintenance, use of property, responsibility for marital debt and genetic testing; refers custody and placement disputes to mediation.
 
Presides over uncontested divorce, legal separation, and paternity final hearings.
 
Manages by hearings and correspondence the collection of fines, forfeitures, court costs and restitution not paid as required by the sentencing judge or court commissioner; monitors compliance with community service orders.
 
On referral from circuit courts, conducts hearings on claims for restitution asserted by crime victims.
 
Presides over initial appearances in small claims and conducts hearings in contested cases.

Presides over contested Chapter 812 garnishment hearings.

Reviews motions for civil contempt in small claims cases and approves orders for hearing before the Circuit Court.
 
Considers and evaluates arrest warrants and search warrants proposed by law enforcement on 24-hour on-call basis.
 
Reviews affidavits prepared by law enforcement to determine if probable cause exists to detain individuals over weekend when courts is not in session.
 
Conducts pre-trial conferences and hearings in family court contempt proceedings.
 
Appoints guardians ad litem in juvenile and family court actions.
 
Reviews petitions submitted by persons seeking Ch. 813 domestic abuse, child abuse and harassment temporary restraining orders and injunctions; issues temporary restraining orders.
 
Plans, schedules, and assigns work to staff; instructs and trains staff in proper methods and procedures; develops policies and procedures; inspects work in progress and on completion; interviews applicants and makes recommendations on new hires; ensures smooth day-to-day operations of the office.
 
Works with Brown County Judiciary and other commissioners, agencies, and groups to develop policies and procedures with respect to the kinds of court proceedings assigned to commissioners.
 
Coordinates efforts of the various court personnel including court reporters, clerks, law enforcement officers, and interpreters assigned to the court; coordinates the efforts of prosecutors and defense counsel.
 
Anticipates future needs of the department and provides relevant information for the budget process.
 
Performs legal research as required.
 
Complies with continuing education requirements established by the Wisconsin Supreme Court.
 
Serves on the Courthouse committees.
 
Responds to informational requests from the public in person, over the phone and by written correspondence.
 
Schedules hearings.
 
Maintains necessary supplies in courtrooms.
 
Receives and distributes filings from law firms and litigants; types court orders.
 
Performs related work as required.
Education and Experience:
Law Degree from an accredited college or university with continuing legal education (15 hours per year minimum), plus minimum of 2 years legal experience required; or any equivalent combination of education, training and experience which provides the necessary knowledge, skills and abilities.
 
Licenses and Certifications:
Licensed to Practice Law in the State of Wisconsin
Knowledge of local, state, and federal laws regarding circuit court activities.
 
Knowledge of judicial proceedings.
 
Knowledge of methods and source materials for legal research.
 
Knowledge of laws regarding traffic, small claims, divorce, juvenile, and criminal matters.
 
Knowledge of general management practices.
 
Ability to prepare and analyze legal documents.
 
Ability to communicate effectively both orally and in writing.
 
Ability to issue fair and equitable orders of judgment and to decide cases.
 
Ability to deal tactfully with contesting parties and their attorneys.
 
Ability to work the required hours of the position.
