This position is exempt from Service Contract Act wage determination. 
The hourly pay rate of $34.00.

Service  Contract Act, or SCA, position pay rates are determined by the U.S. Department of Labor, Wage and Hour Division.

Upon completion of six (6) months of employment, the selected candidate can expect an annual salary as a permanent full-time employee with the federal contractor.


Period of Performance: 

Tentative start date October 1st, 2022 through May 31, 2023, with potential for annual extensions through 2027

Work Hours Operations:  Tentative schedule 8:30 to 5 p.m. or 9 a.m. to 5:30 p.m. Eastern,  Monday through Friday, 8 hours a day, 30-minute lunch break, two 15-minute breaks
  • In the office every day for one to three (1 to 3) months during an initial “learning and training” period, and then will allow flexible telework, which would allow in-person support only two (2) days over a  two-week/ 10 business days pay period  ---  Specific projects that require in-person support may require more days in the office.
  • After the first few months, subcontractors may have some flexibility to set their schedules, within a 6 a.m. to 6 p.m. Eastern time frame window
-  Work schedule is expected to be the same as the supported office personnel
-  If overtime is needed, overtime shall only be performed with the prior approval of the Contracting Officer Representative, COR, and in accordance with contractor procedures
 
  • Telework may be permitted depending on office need, to be coordinated after selection for the position
  • Must have ability to communicate with the customer personnel through e-mail and Microsoft Teams and must maintain their own reliable internet/network access when teleworking

Supervisory Paralegal
Qualifications: 
 
  • Requires Paralegal Certificate.
    • Only the Contracting Officer, CO, can approve a waiver of the Paralegal Certificate
 
  • Minimum three (3) years of litigation paralegal experience, including trial experience
  • Minimum one (1) year of experience in automated litigation support
  • Must have supervisory experience, including proven capabilities and communication skills to successfully interact with clients and attorneys
 
  • Requires sound working knowledge of federal and state court system, legal research procedures, and legal research resources
  • Requires excellent written and oral communication skills and thorough knowledge of legal research tools such as LEXIS and Westlaw
 
  • Must have hands-on familiarity with a variety of computer applications, including word processing, databases (such as document review and file management systems), spreadsheets, and imaging
  • Ability to consistently deliver highest quality work will be very important

Must be a US Citizen and able to obtain a Public Trust clearance


Preferred Qualifications:

-  Familiarity with Electronically Stored Information, ESI, tools and knowledge of e-Discovery procedures and resources preferred


Supervisory Paralegal
Responsibilities/Duties:

Three (3) qualified Supervisory Paralegals who shall work under the direction of the Project Manager to oversee simultaneous small projects and supervise contractor staff.

One (1) Supervisory Paralegal will be assigned to each of the three main categories of litigation support,  listed in the Scope of Work above.

The Supervisory Paralegal shall
a. Organize, direct, and coordinate the planning and execution of all activities, review the work of DMA II, Paralegals, Senior Paralegals, and Law Clerk.

b. Oversee various litigation projects, including management of mandamus litigation, completion of visa petition appeals, and conducting research and compiling materials to support complex litigation and class actions.

c. Perform complex legal and factual research.

For example, supervision of responsibilities/ duties for Law Clerk position include but not limited to:

a. Mandamus Litigation.
The following tasks are required to support the Mandamus litigation:

i. Determine the status and location of the applications/petitions subject of case, whether the relevant cases are outside of processing time, and other factual details to determine the validity of facts as articulated in the complaint, perform all systems checks including, but not limited to, National Files Tracking System (NFTS), Computer Linked Application Information Management System (CLAIMS), Person Centric Query System (PCQS), Tableau.

ii. Review, monitor, provide complex legal research and ensure communication between the Department of Justice and the client for mandamus lawsuits previously determined to be non-defensible pursuant to the client’s policy. Law Clerk will conduct all necessary complex research and correspondence between the DOJ and the operational client to see the case
through to completion (final decision by judge or voluntary dismissal) and notify a client attorney if there are any legal issues with the adjudication of the case or any other problems

iii. Compile, prepare, and summarize relevant materials for use by attorneys in in preparation of status conferences, motions, briefs, and other legal documents.

iv. Use legal research tools such as LEXIS and Westlaw to perform complex legal research as it relates to the Mandamus litigation

v. Use a variety of computer applications, including word processing, databases (such as document review and file management systems), spreadsheets, imaging, and hardware systems

b. Visa Petition Appeals
The following tasks are required to support the Visa Petition Appeals:

i. Organize, update and ensure completeness of individual litigation files


ii. Perform all systems checks including, but not limited to, National Files Tracking System (NFTS), Computer Linked Application Information Management System (CLAIMS), Person Centric Query System (PCQS), Tableau to determine the status and location of the applications/petitions subject of case, and other factual details to determine the validity of facts as articulated in the appeal

iii. Compile, prepare, and summarize relevant materials for use by attorneys in in preparation of the appeal.

iv. Use legal research tools such as LEXIS and Westlaw to perform complex legal research to support the client’s briefing of the defense of the visa petition appeal

v. Use a variety of computer applications, including word processing, databases (such as document review and file management systems), spreadsheets, imaging, and hardware systems

vi. Perform any necessary complex legal research and assist with drafting complex government brief in support of the underlying decision for the client attorney signature

vii. Draft trend reports and narratives summarizing common issues that arise in visa petition appeals

c. Complex/Administrative Procedures Act (APA)/Class Action Cases
The following tasks are required to support the Complex APA/Class Action Cases:

i. Determine the status and location of the applications/petitions subject of case, whether the relevant cases are outside of processing time, and other factual details to determine the validity of facts as articulated in the complaint, perform all systems checks including, but not limited to, National Files Tracking System (NFTS), Computer Linked Application Information Management System (CLAIMS), Person Centric Query System (PCQS), Tableau

ii. Compile, prepare, and summarize relevant materials for use by attorneys in in preparation of status conferences, motions, briefs, and other legal documents.

iii. Use legal research tools such as LEXIS and Westlaw to perform complex legal research

iv. Use a variety of computer applications, including word processing, databases (such as document review and file management systems), spreadsheets, imaging, and hardware systems


v. Compile, prepare, and summarize relevant materials for use by attorneys in discovery and in preparation of motions, briefs, and other legal documents.

vi. Index, track and control document discovery (including documents produced and received in discovery)

vii. Create indexes, and track exhibits and other materials in preparation for hearings.

viii. Prepare exhibit cross-references, and review documents for relevance and privilege according to established guidelines and criteria

ix. Compilation of documents for production requests in complex litigation that includes discovery

x. Use legal research tools such as LEXIS and Westlaw to perform complex legal research in support of complex litigation.

xi. Use a variety of computer applications, including word processing, databases (such as document review and file management systems), spreadsheets, imaging, and hardware systems

xii. Monitor attorney duty mailboxes daily and respond to emails or forward them to appropriate parties as required. Perform all systems checks including, but not limited to, National Files Tracking System (NFTS), Computer Linked Application Information Management System (CLAIMS), Person Centric Query System (PCQS), Tableau to determine the status and location of the applications/petitions subject of case and verify the facts in the complaint

xiii. Compile and prepare Certified Administrative Records (CAR) for complex litigation, including APA and class action litigation
