As Corporate Counsel you will provide legal counsel and advice to the enterprise and various business units on all issues related to legal matters, both domestic and international. Specifically, this role is in support of the Financial Products Division based in Nashville, Tennessee. FPD provides financing and leasing solutions for Caterpillar customers in over 40 countries across the world, as well as aftermarket services to support the maintenance of and maximization of benefits from Caterpillar equipment. The job is located in Nashville, Tennessee and is a full time in person role.
Job Responsibility and Duties Include but not limited to:
- Effective performance of legal functions for the company and its subsidiaries and affiliates.
- Liaison between the Legal Services Division and assigned areas of the business (Services and Marketing, privacy law and financial regulatory compliance) by providing daily counselling requiring accurate interpretation of the law as it applies to various situations and working with outside counsel to deliver timely and accurate advice in areas outside incumbent’s core legal areas of expertise. Incumbent will serve on numerous project teams (cross border; cross divisional; cross discipline) to aid in execution of key enterprise strategic objectives.
- Consult with management on matters involving more significant risk to the enterprise and requiring a high degree of confidentiality.
- Provide oral and written recommendations concerning legal issues applicable to assigned areas of responsibility.
- Familiarity with new or changing laws and regulations in assigned areas and inform management of the effects of these laws on functions. Ideally incumbent would have basic knowledge of most areas of laws and regulations in play in the financial services industry, such that they can issue spot and source answers from research and/or outside counsel.
- Basic competency in GDPR and data privacy law generally a plus.
- Knowledge of Fair Credit/Equal Credit Opportunity Act (Section 1071) a plus.
- Participates in day-to day tactical legal practice, identifying and resolving issues in a focused practice area. Works with internal customers and keeps supervising attorney informed but is given moderate latitude in assigned areas as a staff level attorney.
- Monitor’s quality of services provided by outside counsel and assures timely disposition of legal action. Consulting for the delivery of legal services according to existing policies and legal practice guidelines.
- The incumbent may be a generalist and is assigned to work moderately complex legal matters and operates with less direct day-to-day supervision.
Candidates will have gained the following minimum qualifications, skills and experiences through previous roles:
- Internal candidates must have satisfactorily completed a minimum of one years’ service in their current position to apply for another role, or have obtained, in writing, authorisation from their manager to waive this requirement. Candidates should always inform their manager prior to applying for any new role.
- Internal candidates must not have any live disciplinaries or be on a performance action plan.
- Degree in law from an accredited law school
- 3-5 years experience practicing law in a law firm and/or in house legal department
- An active license or officially qualified or admitted to practice law as in-house counsel to the extent as required in the jurisdiction and candidate shall be in "good standing".
- Excellent communication both written and verbal in English
- Maintain confidentiality
- Interpersonal skills and personal accountability.
