We need a great writer to help us win

The firm needs a great writer to help us win. You need to be a mature writer who writes a great brief (table stakes) and also thinks strategically about what briefs to write. You think all the way to the end of a case, not just two or three moves ahead. (Of course, tunnel-visioning a single document is appalling). You should understand that great writing makes a difference and have already made a decision to dedicate your career to that skill.

If you’ve written a brief that begins with “Comes now” within the last year, stop reading. This job isn’t for you. If you open briefs with mundane, formulaic recitations of party names and defining the plaintiff as (“Plaintiff” or “Smith”) or similar non-sense (hereinafter “the stupidest s**t I’ve ever seen” or “TSSIES”) this isn’t the job for you.

But if you open briefs with something clear and punchy, we’re for you. Ideally, it will be the most important reason your brief should win. A good fact works. Or a powerful legal rule. But you must use good judgment on what will persuade.

You also understand how to think through a case from inception to end. You should understand how early writing effects depositions and trials. You should feel comfortable doing at least ninety percent of the work on a civil case prior to the trial setting conference. You should also understand motions in limine and be prepared to assist with them and trial preparation.

· We reject the concept of a “grey area” between true and false. In every fraud case I’ve tried, the defendant made some attempt to diminish or excuse his conduct by creeping towards a grey area. We shine a spotlight on those folks and leave nothing left but light and darkness.
