What are the responsibilities and job description for the Attorney position at Fairfield County Ohio?
Serves as legal representative for the Child Support Enforcement Agency (CSEA) in support establishment, modification, and termination actions. Approves and prepares Motions in Contempt if payor fails to comply with a court-ordered support obligation. Initiates and prosecutes child support criminal (misdemeanor and felony) filings when statutorily appropriate. Researches and prepares for court in a professional manner, facilitates and prepares Agreed Court Entries when possible, and represents the CSEA in child support hearings and trials. The Attorney must be licensed to practice law in the State of Ohio, remain in good standing with the Supreme Court of Ohio, and complete Continuing Legal Education (CLE) credits as required to remain licensed. Attorney may also supervise a Legal Specialist and conduct regular performance evaluations with the Legal Specialist as appropriate. 40 % Serves as legal representative for Child Support Enforcement Agency (CSEA) (e.g., intra- and interstate actions, stipulations for paternity agreements whenever possible, legal representation at pre-trials and/or trials for paternity or other relevant actions, etc.); gathers needed legal evidence (e.g., dispositions, subpoenas, birth certificate records and witnesses, etc.); prepares motions to show cause if payer fails to comply with court order or other related actions and/or file for default judgment; prepares complaints for support in paternity actions (e.g., medical, support obligations since birth, reimbursement of birth expenses for ADC-related cases, etc.).
25 % Establishes new orders or modifies existing orders (e.g., intra- and interstate actions, including military personnel, etc.); gathers legal documentation pursuant to Ohio Supreme Court rules of evidence; uses statewide child support guidelines in actions for new and modified orders including medical support in motions for new and modified orders; enforces child support and alimony obligations (in conjunction with child support) in actions provided for in ORC 2301.38, 3113.31, and any other relevant statutes.
20 % Conducts a review of all pending support actions; monitors referee reports and journal entries to facilitate appropriate objectives and appeals within legally allowable time frames; ensures adequate legal notices of hearings to all involved parties; initiates personal service when certified mail has been refused; completes or compiles any needed legal documents for cases.
10 % Remains informed of current developments and procedures pertinent to duties.
5 % Supervises assigned legal secretary. Assigns work, approves leave, prepares performance evaluations and recommends disciplinary actionAdmission to the Ohio Bar per Section 4705.01 of the Ohio Revised Code.
