General Summary
This position is responsible for maintaining, administering, and providing guidance and oversight to Granite’s Heavy Civil Group related to Contract Management processes, Small Business Compliance Program, execution and administration of major purchase orders and preparation of contract claims in a manner to ensure timely and efficient resolution of issues, claims and implementation of practices that will reduce or minimize the risk of loss. Granite’s Heavy Civil Group handles heavy civil construction projects that include roadway, bridge, light rail, and dam projects that are typically $50M or greater in value.
Essential Job Accountabilities
1. Provide guidance to project managers and project executives in evaluating contractual matters including changes, delays, directives, notices of concerns to mitigate risks and protect the Company’s interests.
2. Provide projects with assistance and contractual oversight, while collaborating with counsel, regarding flow down of prime contract specification provisions into agreements including review of insurance, bonding, indemnity, payments, compliance [Equal Employment Opportunity (EEO), Disadvantaged, Minority-Owned, Women-Owned, Emerging Small Businesses, Services Disabled Veterans, Business Enterprises (D/M/W/SBE), Disadvantage Business Enterprise (DBE)] and other relevant provisions to ensure subcontract and vendor compliance with the prime contract and risk coverage omissions are avoided.
3. Participates in complex contract negotiations and manages all modifications to existing contracts to mitigate risks and protect the Company’s interests.
4. Assist project leads with interpreting and responding to contract terms and conditions to ensure contractual compliance and responsiveness during the bidding process and execution phases of a project including, but not limited to, preparing Requests for Information (RFI), Notices of Owner Delays, Notices of Changes, Change Order/Modification Requests, Requests for Equitable Adjustment and other formal contractual documentation required to mitigate risks and protect the Company’s interests.
5. Advise project leads with preparing, analyzing, and submitting contract modification requests to protect the Company’s interest and ensure timely completion of all contractual requirements related to the contract work.
6. Support project leads by working with internal counsel on drafting and negotiating non-disclosure agreements, teaming agreements, joint-venture agreements, exclusive dealing agreements, and subcontract agreements with Construction and Design partners.
7. Provide knowledge of the Company’s Small Business Enterprise (SBE) Subcontracting Program in compliance with the SBA ensuring business units compliance.
8. Serve as the primary contact for the Business Unit’s Disadvantaged Business Enterprise (DBE) program by ensuring the business unit receives professional compliance support and training.
9. Provide guidance on Company and governmental procurement policies and requirements, such as Federal Acquisition Regulation/Defense Federal Acquisition Regulation Supplement (FAR/DFARS), Procurement Integrity, Truth in Negotiations Act (TINA), Foreign Corrupt Practices Act (FCPA), foreign anti-bribery laws, and import/export regulations to ensure regulations are being adhered to.
10. Serve as the Small Business Program Administrator including advising, reviewing, and supporting SBE Process Owners as it relates to the understanding and execution of the Company’s SBE requirements.
11. Review Small Business Individual Subcontracting Report (ISR) and Summary Subcontracting Report (SSR) submittals to ensure compliance with SBA requirements.
Education
• Bachelor’s Degree in Accounting, Business Administration, Construction Management, or related field is required
• Juris Doctor preferred
Work Experience
• 12+ years’ contract work experience
• 5+ years' in heavy civil to include working with various state DOTs
• Progressive and well-rounded experience in prime contracts, subcontracts, SBE, compliance, and related functions, in the heavy-civil construction industry
• Working knowledge of construction industry terminology, business practices, contract administration principles, and contract negotiations principals and strategy
Knowledge, Skills, and Abilities
• Proficiency in the use of contract administration principles and practices
• Excellent writing, presentation, and communication skills
• Strong attention to detail
• Strong program management and interpersonal skills
• Ability to provide creative solutions to problems
• Ability to negotiate complex contractual agreements, particularly related to federal contracts
• Thorough understanding of Small Business Administration (SBA) contracting requirements, and ability to effectively communicate Granite’s positions to these requirements when necessary
• Understanding of legal requirements related to contracts, federal procurement, DBE law, etc.
• Proficient in Microsoft Office software programs, specifically Word, Excel, and PowerPoint
• Experience working with SAP or Oracle preferred; experience utilizing the Icertis contract lifecycle management software is a plus.
• Skills and ability to work with limited supervision in a highly autonomous environment
• Ability to implement electronic/software solutions to efficiently manage compliance issues
• Strong ability to multi-task and prioritize issues
