Job Posting for Corporate Counsel at Hertz Local Edition
The Corporate Counsel, Sales and Operations works closely with revenue-generating business and functional units to support Hertz’s sales and operations initiatives. This position is full-time and based in Estero, Florida. Subject to business needs week-to-week, the position is staffed in the office Monday through Thursday and works remotely on Fridays.
The role will support the company’s financial success by providing pragmatic, business focused and risk-based legal counsel and guidance on a wide-array of commercial matters involving the company’s sales and rental car operations organizations. This role reports to the Vice President, Chief Counsel, Operations and Strategy and will support the Company’s rental car operations in North America as well as the sales organizations within the rental car operations, revenue management and sales departments.
What You Will Do:
Develop an in-depth understanding of Hertz’s business and its competitive and risk environment and its customer-facing terms and conditions, and serve as a trusted partner by providing risk-based legal counsel and guidance.
Provide daily legal support to the company’s Sales and Operations teams, including provision of advice on federal, state, provincial, municipal, local and other applicable rules and regulations relevant to the Company’s rental car operations as well as consumer related issues.
Structure, draft, review, and negotiate sales agreements, rental referral agreements, government contracts, confidentiality and non-compete agreements, and other related documentation including coordination with privacy and data security counsel and other subject matter experts as needed.
Prepare and communicate written and oral summaries, guidance documents and operations procedures to support legal / regulatory compliance and mitigate risk.
Support continuous improvement of Hertz’s customer-facing terms and conditions and associated disclosures to ensure legal compliance in an evolving operational, regulatory and technological landscape.
Support strategic product development and rental car operations initiatives.
Mitigate legal and financial contractual risks, ensuring fair, favorable, and consistent terms across agreements.
Counsel the business on contract interpretation.
Support business colleagues in resolving pre-litigation contract disputes.
Support the development, improvement, standardization and simplification of contracting processes, including document filing and retention.
Deliver business-oriented legal counsel in a timely, positive, collaborative and constructive manner.
Communicate effectively up, down and across the company to gather information needed by the team, and to share information as appropriate. Requires gaining a thorough knowledge of company policies, practices and people, particularly as it relates to the work of the teams supported. Also requires building and maintaining good relationships with internal and external contacts.
Manage outside counsel billing and other invoicing, using the Legal Department’s matter management and bill paying technology tools.
Be a vocal advocate and champion for Hertz’s culture of adhering to strong ethical standards.
Utilizes Microsoft Office Suite, matter and document management systems, Oracle, and other customary legal software tools.
Assist with other matters as needed.
What We Are Looking For:
Required to be admitted to the bar and in good standing in Florida or admitted to the bar and in good standing in another state and eligible for limited licensure of in-house counsel in Florida.
Minimum 3 years’ experience in a law firm or corporate law department. Experience in commercial contract negotiation and management required; experience with the automotive or rental car industry ideal; experience with consumer issues preferred.
Excellent oral and written communication skills; able to effectively explain complex legal issues to non-lawyers.
A self-starter; must possess discipline to independently follow up on matters and to work flexibly in a fast-paced environment with a high level of autonomy.
Must be well organized, detail oriented, and able to manage numerous projects and conflicting demands in ambiguous situations.
Must be able to cooperatively work with management, colleagues in the legal department, internal stakeholders across multiple functions, and outside counsel.
Excellent critical thinking and business judgment and an ongoing curiosity about how their work fits into the bigger picture.
Exceptional customer service and interpersonal skills.
Results driven, ability to make decisions and help solve problems.
Ability to work under minimal supervision with a goal-oriented mindset.
We expect the starting salary to be around $100,000 to $110,000 with annual bonus and profit sharing eligibility. The actual salary will be determined based on years of relevant work experience. This position will remain open until its filled.
