Summary of Opportunity:
Become the third member and an integral part of a small and dynamic legal team at a mid-size and growing natural products and supplements company. This position will work directly with the company's General Counsel and Regulatory Counsel on wide-ranging matters which may include advertising law, IP law, litigation, regulatory, contract law, food law and other corporate legal matters.  This position requires a driven attorney with the willingness to learn about all different areas of law in a fast-paced environment as well as be willing to become familiar with the supporting science that substantiates the companies over 100 unique consumer products. It is important that this person is organized and has the ability to handle multiple projects at a time.


Primary Responsibilities:
  • Interface with outside attorneys, courts and agencies on legal matters, and acting on behalf of the General Counsel.
  • Act as liaison with other departments.
  • Continuously build a current working knowledge of laws and regulations most relevant to the company and its businesses including DSHEA and all applicable agencies, such as the FDA, FTC and National Organic Program, participating as appropriate in industry groups, trade associations, seminars and continuing education.
  • Keep tabs on litigation trends in the industry with a focus on creating preventative measures that insulate the company from those trends.   
  • Continuously build a working knowledge and understanding of the current and future products of the company and the science behind their claims.
  • Evaluate the availability of potential product names and perform preliminary trademark searches, enlisting the support of outside counsel as necessary; and keep apprised of any other IP rights that may expose the company to unnecessary risk.
  • Participate with R&D, Technical Affairs, Marketing and Consumer Affairs in monitoring the nutritional supplement marketplace in general and company products/ingredients in particular for any emerging safety and/or quality issues reported by regulatory agencies, news/trade organizations or directly by customers.
  • Help manage  outside counsel in their preparation of trademark applications and  their monitoring for potential infringement of company trademarks on an ongoing basis. Manage an internal listing/filing system to track due dates for trademark filings and renewals to ensure that outside counsel meets deadlines and takes necessary action. Keep the Executive Team and Marketing apprised of any important issues that arise.
  • Periodically get involved in business contracts in roles ranging from drafting simple agreements to reviewing draft agreements to participating in direct negotiation/finalization and to fully managing through outside counsel.      
  • Compose and prepare confidential correspondence, reports, charts, legal documents and other complex documents.
  • Read, interpret, and track legal documents as they relate to company litigation, contracts, regulations, and advertising.
  • Handle legal administrative tasks including scheduling and maintaining a legal calendar – including all due dates, submitting and tracking internal requests.
  • Advise regarding and implementing Document Retention Policy.
Experience:
  • Minimum of 0-2 years of experience practicing law within a law firm or as corporate counsel.   It is preferred, but not required, that a substantial portion of that experience is directly advising dietary supplement, food or cosmetic companies.  Any experience related to the hemp/CBD industry is a bonus.
  • Outstanding skills in speaking, writing, organizing, analyzing and negotiating.
  • Superior judgment and demonstrated ability to work with minimal supervision.
  • Self-directed with the proven ability/experience to provide accurate, timely and effective legal support either directly or through outside attorneys.
  • Proven experience providing sound leadership and advice within a team-oriented corporate environment, giving due consideration to the views of individual team members.
  • Licensed in California or  eligible to register for in-house counsel status. (Member of a State Bar)  If not licensed in California, eligible to take the California State Bar.
Education:
  • Juris Doctorate from an Accredited Law School
Desired Experience:
  • Technical and/or scientific background helpful. Proficient in using Microsoft Office.  Proficiency in peparing Excel spreadsheets is a bonus. Will consider Law Clerk and/or Intern experience.
