Minimum Qualifications

MINIMUM QUALIFICATIONS:

Transfer Opportunities: Candidate must have one year of permanent competitive or 55-b/c status in the posted title and be eligible for lateral transfer; or eligible to transfer via section 70.1, 70.4, or 52.6 of Civil Service Law. The transfer cannot be a second consecutive transfer resulting in an advance of more than two salary grades.

Provisional Appointment: In the event that there is not a valid eligible list, candidates who meet the minimum qualifications below may be qualified for a provisional appointment.
The Civil Service promotional examination for this title was held October 21, 2023, to be eligible for a provisional appointment, candidates must have one year of competitive or 55-b/55-c service as a Human Resource Specialist 2 (Labor Relations) or Human Resources Specialist 2 and must have taken this examination. Candidates who have not passed the examination or do not achieve a reachable score on the resulting eligible list may not be retained in these positions.


Duties Description
PRIMARY DUTIES AND RESPONSIBILITIES:
The Bureau of Employee and Labor Relations represents the Agency in the administration of collective
bargaining agreements with more than 20,000 state employees. The Labor Relations (LR) representatives
administer the statewide Labor Relations processes for OPWDD employees, including acting as the point
person for local labor management activities in one or more OPWDD Districts, evaluating evidence and writing
Notices of Discipline, and representing OPWDD at hearings before arbitrators, PERB, and others. The LR
representative answers and resolves grievances, provides support to human resources professionals and
other managers, and may provide relevant training on topics such as performance evaluation, administering
grievances, counseling and discipline. The bureau is responsible for the administration of bargaining unit
contract agreements with multiple public employee unions representing the Agency's employees.
Under the supervision of the Regional Associate Director of Human Resources Region 3, the Human
Resources Specialist 3, Labor Relations may be responsible for:
  • Managing the Labor Relations operations for Capital District and Sunmount Developmental Disabilities
Service Offices (DDSO).
  • Acting as the Central Office Labor Relations liaison with officials from all bargaining units which serve Agency
employees.
  • Working with union representatives to resolve workplace issues, including policy and contract interpretation.
  • Conducting investigations into employee misconduct.
  • Reviewing and analyzing investigative reports and resolving disciplinary cases through settlement or binding
arbitration.
  • Providing support and advice to supervisors and Human Resources professionals.
  • Acting as liaison with the Office of Employee Relations on Grievance Arbitrations and PERB-related matters.
  • Participating in District-level and labor management meetings and subcommittees.

  • CAPA: Must be cleared by NYS Central Registrar for Child Abuse and Maltreatment if position requires working with minors and not previously cleared.
