Job Description
The Lease Compliance Analyst will contribute to rue21’s success by managing a portfolio of the Company’s leases for its retail stores. They will have a wide range of responsibilities that includes working with real estate leases, managing payments made to landlords, and working with the Company’s lease database. They will work closely with internal rue21 teams as well as landlords to address various issues that may arise from time to time.
• Abstract, interpret, input, and analyze information on leases, amendments, assignments, and other legal documents in accordance with departmental policies. Enter all required data into lease management software known as Lucernex and maintain data to ensure integrity.
• Communicate all lease terms including construction information to internal departments such as Real Estate, Accounting, Finance and Facilities.
• Draft Estoppel Certificates and SNDA’s.
• Responsible for the accurate and timely payments of monthly charges in excess of $5mil per month.
• Conduct desk top audits of CAM, real estate tax, insurance, and other miscellaneous billings to ensure lease compliance and accuracy of calculations. Formulate appropriate responses and communicate with all parties necessary to resolve any disputes related to the charges. Communicate additional details as required. Prepare appropriate payment/credit transactions and update all records to document the final resolution.
• Review invoices, statements, budgets and payment adjustments and process appropriate payments and/or credits. Ensure billings are processed accurately in compliance with lease terms. This includes deducting non-reimbursable lease charges.
• Responsible for sales reporting to landlords and the payment of percentage rent.
• Analyze and interpret lease language and underlying legal documents to ensure compliance. Investigate requests from third parties on a variety of issues related to store operations, and landlord disputes. Determine best course of action and provide recommendations for resolution. Formulate and communicate rue21’s position and take actions necessary to ensure all lease obligations are met.
Set-up and changes to rent vendors within Lucernex. Ensure receipt of appropirate documents to make changes.
• Assist in the resolution of any disputes related to landlord’s failure to perform all of landlord’s required repairs and maintenance at the stores. Participate in the formulation of and execution of a plan of action, including the issuance of any lease required notices, and coordinate with the Facilities team to ensure the proper completion of all needed repairs.
• Responsible for the set-up of new vendors and payment address changes
Review and distribute Lease Compliance mail
• Maintain accurate and up to date records in the appropriate permanent Lease files – both electronic and hard copies.
• May perform other duties as assigned.
Qualifications
•5-10 years of experience
• Engaging interpersonal and presentation skills
• 3-5 years of experience in retail lease administration / reconciliation/ lease audit/abstraction
• Paralegal experience a plus
