Job duties:
- The Attorney III is a Staff Attorney in the Office of General Counsel and serves in the area of child welfare policy and practice, supporting the Child Welfare Services Division with projects, initiatives, and work efforts designed to improve the quality of child welfare services programs. Attorney will also represent the agency in assigned cases for administrative hearings and other litigation and assist senior attorneys in the Office of General Counsel on a broad range of legal matters affecting the Agency.
- Assist senior attorneys in OGC in supporting Child Welfare Services with projects, initiatives, and work efforts designed to improve the quality of child welfare services programs. Assists with monitoring and interpreting federal child welfare policy and participates in development and review of state plans and reports for child welfare. Handles special projects as requested by senior attorneys in the Office of General Counsel. Serves in agency or department teams and projects as a legal staff representative. Provides support to county attorneys when needed.
- Represents the agency in all aspects of assigned litigation of cases at administrative hearings, trial and appellate courts, to include research, brief and order writing and appellate arguments. Provides legal advice to all levels of administrative officials on policy and operational questions having legal implications. This position will assist primarily, but not exclusively, with the litigation of Foster Home licensing, Group Home licensing, CPA licensing, TANF/FI cases, and Adoptions Supplemental Benefits cases.
- Develops and maintains specialized knowledge in areas of foster care, adoptions, permanency planning, associated Title IV-E and Medicaid Funding Requirements, and the TANF Program and serves as a consultation resource to staff and outside counsel in those areas.
- Litigates complex and difficult cases for DSS, including trial and appellate cases. Represents DSS in adoptions when children are legally free and in administrative appeals related to adoptions.
- Completes additional duties as assigned, including but not limited to conducting research on applicable law, regulations, and policies.
- Monitors and acts as liaison between DSS and outside counsel in tort, contract, and civil rights lawsuits involving civil damages, declaratory, or injunctive relief.
- Performs Red Cross shelter duty or other emergency shelter duty/services as directed.
A Juris Doctorate Degree from an ABA accredited law school and three (3) years of experience as a Practicing Attorney.
Special Notice: Must be a member of the South Carolina Bar.
Experience as a DSS attorney preferred.
