What are the responsibilities and job description for the Data Privacy Ombudsperson position at State of Utah?
The Office of Data Privacy (ODP) is seeking a Data Privacy Ombudsperson that will serve as a knowledgeable resource on data privacy matters and be responsible for the development of initial privacy complaint, mediation, and dispute resolution protocols for the Utah public and governmental entities. The Ombudsperson will be appointed by the governor with the advice of the Utah Privacy Governing Board and will be familiar with the provisions of relevant privacy law, including: Title 63A, Chapter 19, the Government Data Privacy Act; Title 63A, Chapter 12, Division of Archives and Records Service and Management of Government Records; Title 63G, Chapter 2, Government Records Access and Management Act; Title 63G, Chapter 3, Student Privacy and Data Protection Action; Health Insurance Portability and Accountability Act of 1996 (HIPAA), Pub. L. 104–191, 110 Stat. 1936; and the Family Educational Rights and Privacy Act (FERPA), 34 C.F.R. Part 99.

The Agency:
The newly established Office of Data Privacy, created as part of the Government Data Privacy Act, is composed of dedicated privacy professionals spearheading Utah’s privacy efforts. As a division of the Department of Government Operations, the Office collaborates closely with all governmental entities and the public to improve data privacy practices across the state.
Complaint Resolution:
Develop and maintain complaint resolution protocols for individuals making or responding to complaints about a governmental entity’s data privacy practices.
Serve as the primary point of contact and resource for individuals and governmental entities in resolving data privacy-related complaints.
Provide guidance, support, and information to individuals and governmental entities involved in data privacy-related complaints.
Mediation and Dispute Resolution:
Upon request, mediate data privacy disputes between individuals and governmental entities.
Facilitate discussions to facilitate resolutions through a fair and impartial process that adheres to data privacy laws and regulations.
Governance Support:
Consult with the Chief Privacy Officer or the State Privacy Officer to raise issues and questions before the governing board regarding serious and repeated violations of data privacy by governmental entities.
Provide input and recommendations for improving data privacy practices of governmental entities based on insights gained from mediation and dispute resolution activities.
Collaborate with the Chief Privacy Officer and other relevant stakeholders to review and make recommendations to improve data privacy practices of governmental entities.
Training
Educate and provide training to governmental entities and the public regarding individuals’ privacy rights, pertinent privacy regulations, and the privacy obligations of governmental entities.
Must have a Juris Doctorate and be a current member and in good standing with Utah State Bar Association.
Demonstrated knowledge and understanding of data privacy laws, regulations, and best practices.
Experience in mediation, dispute resolution, or a related field.
Excellent communication, interpersonal, and conflict resolution skills.
Ability to work effectively with individuals from diverse backgrounds and varying levels of understanding of data privacy issues.
Strong organizational skills with the ability to manage multiple tasks and priorities effectively.
Detail-oriented and able to maintain confidentiality and discretion.
- This position is currently a hybrid of both in-office (2 days a week in office required) and telework days. The office is located at the Utah Department of Government Operations Office of Data Privacy (ODP); 4315 South 2700 West, Taylorsville, UT 84129. Please note, a position's eligibility for telework is established by agency management and is subject to change at their discretion at any time and for any reason.
Employment contingent on passing a drug screening and a background check.
Risks found in the typical office setting, which is adequately lighted, heated and ventilated, e.g., safe use of office equipment, avoiding trips and falls, observing fire regulations, etc.
The work may require in and/or out of state overnight travel.
Typically, the employee may sit comfortably to perform the work; however, there may be some walking; standing; bending; carrying light items; driving an automobile, etc. Special physical demands are not required to perform the work.
