Duties

Major duties for this position include the following, but are not limited to:

As Chief of the Division of Regulations, the incumbent has primary responsibility for planning and directing activities related to: (1) the execution of a program related to the development of regulations, interpretive bulletins, and similar guidance; (2) providing analysis, advice, and solutions on regulatory, legislative, and other related issues arising under ERISA to senior EBSA officials, other Department and Governmental agencies, Congressional committee members and staff, and the public; (3) providing technical support and guidance to other ORI divisions, EBSA offices, DOL agencies, and other Federal and State regulators, on regulatory, enforcement, legislative, and policy issues; and (4) as appropriate, participating in the development of technical assistance memoranda, opinions, forms, and other guidance issued by the Office of Regulations and Interpretations.

Notification Concerning COVID-19 Vaccinations. Qualifications

Requires one (1) year of specialized experience equivalent to the GS-14 level in the Federal Service as defined below:

Specialized experience is defined as: Progressively responsible experience that demonstrated the ability to perform work in the field of employee benefit plans and/or health insurance. Such experience may have been gained in (1) management, administration, development, analysis, audit, financial management, or termination of such plans or their funds; or (2) in closely related work, such as health insurance.

Specialized experience may have been gained in government, employee benefit plan administration or consulting, a law firm, an actuarial or accounting firm, a labor union, a relevant trade association or research service, or an insurance company. Examples of qualifying specialized experience include:

Analysis and application of the Employee Retirement Income Security Act (ERISA) and related laws, regulations, court decisions, and precedent rulings.
Development of employee benefit plans, petitions for exemptions, or requests for rulings under governing law.
Legal work, a substantial portion of which required interpretation of Federal laws and legal requirements concerning employee benefit plans, or in related fields as health insurance.
Auditing or accounting work that involved determining compliance with Federal and State laws governing employee benefit plans, or insurance.
Analysis of Federal laws or regulations, development of policy, and drafting of proposed changes in an employee benefit plan or a related function.

For this position, specialized experience would be defined as experience preparing: (1) analysis and application of fiduciary, reporting and disclosure, preemption, COBRA and other provisions of the Employee Retirement Income Security Act and related laws, regulations, court decisions, and precedent rulings; (2) regulations, rulings, requests for exemptions, or rulings under governing law; (3) legal work, a substantial portion of which require interpretation of Federal laws and legal requirements concerning welfare and pension plans, or in such related fields as taxation, securities, insurance, trusts, and investments.

Education

There is no education substitution for specialized experience.

In addition, supervisors are responsible, when requested, for assisting agency ethics officials in evaluating potential conflicts of interest and identifying positions subject to financial disclosure requirements.
