Public Defense Attorney I - Grade 19 ($6,421-$8,332/month)
Public Defense Attorney II - Grade 22 ($7,432-$9,644/month)
Public Defense Attorney III - Grade 25 ($8,603-$11,165/month)
Public Defense Attorney IV - Grade 27 ($9,484-$12,308/month)
This is a professional legal position providing legal defense services to indigent persons on behalf of the Benton County Office of Public Defense. An employee in this position will be assigned by the Court or Office of Public Defense to provide criminal defense representation to indigent defendants facing misdemeanor or felony criminal charges in Benton County District or Superior Courts. Representation will involve all phases of criminal proceedings including initial appearances, arraignment, pre-trial hearings, trial, plea negotiations, sentencing, and appeals from District Court. Primary caseload will consist of misdemeanor cases filed in District Court but responsibilities will also include preliminary appearance representation in Superior Court and appearance before Superior Court for District Court appeals.
The Benton County Office of Public Defense operates an intensive training and mentoring program for new Staff Public Defense Attorneys under the close supervision of the District Court Mentorship Supervisor. This program is designed to maximize a new Public Defense Attorney's success by providing the tools, resources and skills necessary to be an effective public defender in the courts of Benton County. Public Defense Attorneys are expected to successfully complete this training and mentoring program within the first six months of their position. Opportunities for professional and promotional growth (including assignments to other Public Defense Units such as Juvenile Court or Superior Court) are contingent upon successful completion of this program.
Benton County reserves the right to conduct interviews and/or make employment offers before the closing date for this announcement. Review and evaluate new criminal cases as assigned. This includes reviewing police reports and other reports to evaluate case strengths, weaknesses, and legality.
Meet with and/or interview defendants to determine facts of the case and to advise defendants on risks or benefits associated with available courses of action in defending cases. Keep clients reasonably informed of the status of their case and promptly respond to requests for information. Explain essential concepts, facts, and legal issues to clients to such a degree as to allow them to make informed decisions about their cases.
Represent assigned clients at all stages of criminal proceedings including, but not limited to, arraignments, pre-trial motions, post-trial matters, restitution hearings, sentence reviews, and furlough requests.
Prepare, draft, and argue appropriate motions necessary to the defending of assigned criminal cases.
Investigate assigned cases as necessary, enlisting the assistance of investigators and/or experts if necessary.
Manage the plea bargaining process to the best benefit of clients.
Provide representation at sentencing proceedings, post-trial motions, and revocation proceedings as needed.
Conduct all trial actions including selection of jury, cross and direct examination, introduction of evidence and exhibits, and making arguments on the law and interpretation of the evidence.
File, present, and argue appeals to Superior Court from District Court through the Rules of Appeals of Decisions of Courts of Limited Jurisdiction process.
Maintain a substantial caseload of clients.
Maintain regular, predictable, and punctual attendance during regularly scheduled work hours at assigned worksite.
Provide provisional, limited, docket representation of defendants at preliminary appearance and arraignment dockets in both Superior and District Courts
Assist other, more senior, Public Defense Attorneys as necessary and from time to time, with limited duties and functions in Superior Court matters
Meet travel requirements of position.
Performs other related duties assigned.This position requires a current Washington State Bar membership in good standings. Candidates who are sitting for the next Bar Examination (and have the necessary skills, experience and aptitude) may be considered for an offer contingent upon bar passage.
Position also requires a valid Washington State driver's license and passage of Benton County background investigation.
Ideally, at least 6 months experience in defending or prosecuting criminal cases including direct experience in at least two jury trials either as primary or assisting (second chair) counsel. An appropriate combination of practical experience (including internships or externships) and trial advocacy clinics may substitute for the required experience.Familiarity with statutes, court rules, constitutional provisions, and case law relevant to criminal law practice in the State of Washington.
Familiarity with collateral consequences of the criminal conviction including possible immigration consequences and the possibility of civil commitment proceedings based on criminal convictions.
Familiarity with mental health issues including the ability to identify the need to obtain expert services in that regard.
Strong personal computing skills including use of common business software.
Ability to manage time and prioritize work under varying conditions, deadlines, and levels of stress.
Ability to manage a substantial caseload of clients.
Ability to communicate effectively both verbally and in writing.
Skill in analyzing and organizing materials for persuasive and effective presentations.
Proven ability to exercise sound judgment in making legal decisions, interacting with colleagues, consulting with senior attorneys and supervisors, and working either individually or as part of a team as necessary.
Proven ability to work with others including clients and other stakeholders in the criminal justice system in a professional and effective manner even under difficult, adversarial, or stressful situations.
