    JOB TITLE: Tribal Employment Rights Ordinance (“TERO”) Compliance Officer
    DEPARTMENT: TERO
    FLSA STATUS: Non-Exempt
    Salary: $22.25 per hour non-negotiable

    SUMMARY : Under the direction of the TERO Compliance Manager, (“Manager”) this position will primarily be responsible for performing various clerical and related administrative duties in the implementation of Tribal Employment Rights Office (TERO) in relation to Indian Preference in hiring, contracting and sub-contracting with the Tribe, its entities, and covered employers.
    ESSENTIAL DUTIES AND RESPONSIBILITIES: Including but not limited to the following duties and responsibilities.
    • Ensures TERO compliance for employment hiring matters of organizations and companies within the jurisdiction of the Torres Martinez Desert Cahuilla Indians Tribe (“Tribe”)
    • Mitigates complaints related to TERO compliance with contractors, employees, vendors and participants
    • Maintains specified records, files, logs, and databases to ensure accurate reporting of compliance matters
    • Monitors compliance and conduct investigations as related to TERO
    • Conducts site visits to ensure compliance with all Tribal, Federal, and State employment laws
    • Issues citations for non-compliance
    • Interacts with relevant outside federal, state, and local agencies for programming needs
    • Works in partnership with other Tribal departments to ensure compliance with Tribal Administration Policies and Procedures, Tribal Ordinances, and Tribal Standards
    • Provides outreach and education to Indian owned businesses relative to the TERO
    • Assists Indian employers in obtaining certification as requested making appropriate referrals for services needed
    • Assists individuals seeking participation with the TERO job bank
    • Provides transportation services to eligible participants
    • Establishes compliance standards within TERO Office
    • Provides scheduled reports to the TERO Commission, Tribal Council, and General Council
    • Maintains public trust
    SUPERVISORY RESPONSIBILITIES:

    Non-supervisory.
    OTHER DUTIES:
    • Attend meetings
    • Attend mandatory training
    • Travel as required to perform duties
    • Perform related duties as assigned

    QUALIFICATIONS: To perform this job successfully, an individual must be able to perform each essential duty satisfactorily. The requirements listed below are representative of the knowledge, skills, and/or abilities required.

    A BI L I T Y TO:
    • Apply cultural sensitivity to cultural relevant programming, primarily Native American
    • Enforce the Tribe’s TERO
    • Demonstrate leadership skills, including negotiation, problem solving, and decision making
    • Establish and maintain cooperative and effective working relationships with the staff, community groups, and other related agencies
    • Communicate effectively both orally and in writing
    • Operate standard office and classroom equipment including a computer and assigned software
    • Observe and follow health and safety regulations
    • Operate and maintain assigned motor vehicle
    • Work with minimal supervision on assigned duties
    EDUCATION and/or EXPERIENCE: An equivalent combination of education and related work experience may be considered. Two (2) years of related work experience will be equal to 30 college credits and vice versa.
    Associate in Arts Degree required in Business Administration, Management and minimum of two (2) years responsible experience in Tribal Employment Rights, Tribal Administration, Tribal Law, or related field required. OR
    High School Diploma or equivalency certificate required and four (4) years of related experience and minimum of two (2) years responsible experience in Tribal Employment Rights, Tribal Administration, Tribal Law, or related field required.

    CERTIFICATES, LICENSES, AND REGISTRATIONS: To perform and to continue to be qualified for this position, the requirements listed below must be met at a time of hire or may be obtained within a specific amount of time depending on the position requirements. Costs for required certifications, licenses, and registration are to be covered by employees, unless offered by the Tribe.

    Prior to hiring and throughout employment must possess a valid California Class C Driver’s License and maintain insurability under the Tribe’s vehicle insurance policy

    TMDCI Member/Indian Preference Policy:
    The Tribe shall, to the greatest extent feasible, give preference in employment to Indian applicants who meet the required qualifications in accordance with applicable law, including the TERO Ordinance. “Indian preference in employment” as used in this policy, applies in all aspects of the employment relationship including, hiring, termination of employment, promotion, training, transfer, and related issues.

    The Torres Martinez Desert Cahuilla Indians are required to implement the Drug Free Workplace Act of 1988 (41 U.S.C. §741 ). As such, it is unlawful for employees to manufacture, distribute, dispense, possess, or use a controlled substance on the job site. Employees that are reasonably suspected of violating this Act may be subject to drug testing as a condition of employment. A drug screening test will be given to all applicants prior to employment.
    Essential Government Functions:
    All work performed under this job classification is in support of essential governmental functions of the Torres Martinez Desert Cahuilla Indians.
