    SUMMARY

    Under general supervision of the Executive Director, the Property/Liability Claims and Risk Manager plans, directs, manages, and oversees the activities of the Property/Liability Claims Department, including the development of claim management policies and procedures. The Property/Liability Claims and Risk Manager coordinates assigned activities with other departments, members and outside agencies that deliver cost-effective claims and risk management and develops programs and services designed to prevent or mitigate loss related to property and liability exposures and provides highly complex assistance to the Executive Director, Board of Directors and Members. The position requires excellent communication skills, proactive thinking, and the ability to manage, investigate, analyze and evaluate highly complex claims.

    EXAMPLES OF DUTIES

    Claims Administration/Supervision Responsibilities

    · Assume full management responsibility for all department services and activities. Manage the processing of claims for the Property/Liability Department, including receiving and reviewing new claims; ensuring entry of claims into the claims information system; maintaining claim files and records; and making appropriate and timely claim payments.

    · Manage and direct the development and implementation of departmental goals, objectives, policies and priorities for each assigned service area.

    · Establish, within NBSIA policy, appropriate service and staffing levels; monitor and evaluate the efficiency and effectiveness of service delivery methods and procedures; allocate resources accordingly.

    · Plan, direct and coordinate, through subordinate level staff, the Property and Liability department’s work plan; assign projects and programmatic areas of responsibility; review and evaluate work methods and procedures; meet with key staff, members, and outside agencies to resolve problems.

    · Assess and monitor workload, administrative and support systems, and internal reporting relationships; identify opportunities for improvement; direct and implement changes.

    · Select, train, motivate and evaluate assigned personnel; provide or coordinate staff training; work with employees to correct deficiencies; implement discipline and termination procedures.

    · Oversee and participate in the development and administration of the department budget; forecast funds needed for staffing, training, equipment, programs, materials and supplies; approve expenditures and implement budgetary adjustments as appropriate and necessary. Work with a variety of people to analyze, investigate, and research claims, including Members, legal counsel, medical evaluators and investigators; and provide and collect information necessary to effectively defend and resolve claims.

    · Educate claimants on the claims process; understand laws and regulations related to liability claims.

    · Investigate liability claims including bodily injury, employment practices, public official errors and omissions; interview member district representatives, claimants, and witnesses. Investigation may include field investigations, take scene photographs; take statements.

    · Work closely with excess insurance carriers on reporting and monitoring of claims.

    · Represent NBSIA Members at settlement hearings, mediation, arbitration, or other dispute resolution processes.

    · Manage a responsible caseload of highly complex property and liability claims including investigation, litigation management, settlement and adjustment functions.

    · Organize, coordinate and track professional assistance and performances from legal counsel and investigators; supervise the selection of outside agencies servicing our claims.

    · Professionally represent the Property and Liability department to other departments, members, and outside agencies and organizations.

    · Provide assistance to the Executive Director, participate on a variety of boards, commissions and committees; prepare and present staff reports and other necessary correspondence.

    · Attend and participate in professional group meetings; stay abreast of new trends and innovations in the field of property and liability.

    · Supervise all employee(s) of the Property/Liability Department, including oversight of responsibilities, performance management, growth and development, hiring, and discipline.

    Risk Management

    · Build and maintain relationships with the Board of Directors, Members, and outside parties with whom NBSIA does business.

    · Assist with NBSIA communications specific to the Property/Liability program.

    · Identify claim and exposure trends and recommend appropriate and proactive action to the Executive Director (i.e., Member Alert, policy language, program opportunities, coverage options, and member training).

    · Use professional judgment to assess the risk of proposed member events or programs and offer recommendations to assist with managing or eliminating that exposure.

    · Collaborate with NBSIA and member staff to develop and offer programs designed to protect member staff, students and the public from harm or loss.

    · Develop suggested or required risk management practices for Members, and provide training, resulting in a reduction of claim frequency and severity.

    · Employ pre-loss legal services to prevent or mitigate the impact of potential losses.

    · Work with insurance carriers to coordinate inspections or investigations.

    · Review contracts and Certificate of Insurance requests.

    · Supervise and manage designated liability risk management programs.

    · Participate in risk pool industry committees, peer groups, Boards of Directors, and bring back knowledge gained to benefit NBSIA Members.

    · Regular and reliable attendance is essential.

    QUALIFICATIONS

    Must exhibit a professional demeanor, enthusiasm, integrity, leadership, and a strong understanding of the fundamentals of liability and risk management. Will be forward thinking, a creative problem solver, proactive, and able to manage challenging situations. Must have the ability to build strong relationships with our Members and third parties. Must be able to guide and work closely with NBSIA team members, while supporting the needs and objectives of the organization as well as our member districts. Prior experience providing legal guidance and advice on property and liability subject matter is preferred.

    Deep knowledge of: the fundamental principles of risk management and property/liability insurance coverage, the Tort Claim Act, legal statues and civil procedures related to civil liability; property and liability claims adjusting (including litigation management), evaluation of the value of claims, and necessary experience to manage claims from the first report to settlement or closure; contract review, including insurance and indemnification language; appropriate reserving practices and techniques; creative pre-loss legal problem solving; professional oral and written communication skills; public speaking techniques; computer skills sufficient to maintain the risk management information system; and prior supervisory experience.

    Ability to: organize and prioritize workload; conduct complex investigations; connect effectively with, and relate to, all business associates, while simultaneously building credibility and rapport; organize, develop, and prepare claims for assignment to counsel, trial and pre-trial conferences; learn, interpret and apply specific rules, laws and policies necessary to apply them with good judgement in the administration of public entity claims; demonstrate assertiveness and quick response times in solving problems while exhibiting judgement and a systematic approach in decision making; articulate, develop and present well thought- out reports, analyses and communications; communicate eloquently through oral presentations and written reports; analyze situations and adopt effective course of action independently or from verbal and written direction; and represent NBSIA to members, brokers, carriers and others in a manner consistent with the policies, practices and procedures of the organization.

    Education and Experience:

    · At least 10 years of progressively responsible leadership and administrative experience in public sector property and liability claims/litigation management or a related field.

    · A minimum of five years of supervisory experience.

    · Bachelor’s degree in Business, Public Administration, Insurance, or related field from an accredited college or university.

    · Juris Doctor degree and California Bar license preferred.

    · CSRM or ARM designation is preferred.
