    POSITION SUMMARY:
    This position leads our global trade compliance program, ensuring compliance with all applicable import/export laws including Export Administration Regulations (EAR), Office of Foreign Asset Controls (OFAC) regulations and programs, economic and trade sanctions programs, and U.S. and international customs and border protections regulations. This role assesses, designs, and maintains processes and systems that ensure all product shipments and other business activities are conducted in a manner that is compliant, sustainable, and an improvement on the effectiveness of the company’s global trade compliance and third-party due diligence monitoring activities. The position advises and acts as the primary contact for all inquiries, inspections, and information requests related to trade compliance laws. This position also has other compliance responsibilities including leading and performing the anti-bribery and corruption program includes ensuring compliance with FCPA and other applicable corruption laws and regulations, driving implementation of third-party risk management controls within procurement and sales business processes, and U.S. government contracts compliance. The position reports to the General Counsel.

    RESPONSIBILITIES:
    Trade Compliance

    • Lead the company’s global export and import compliance program, provide strategic direction in assessing, sustaining, and enhancing practices and policies to ensure compliance with all applicable trade laws and regulations. Oversee EAR and OFAC compliance.
    • Develop global trade compliance roadmap and strategy.
    • Supervise trade compliance program assessments and monitoring, including data analysis protocols, and drive associated action plans.
    • Stay up to date with legal, regulatory, and trade developments that impact business and provide timely legal guidance to identify risks and mitigate impacts.
    • Ensure availability of appropriate metrics, data analytics and compliance reports against which the Company can measure the effectiveness and continuous improvement the program.
    • Adeptly assess costs and benefits of possible changes or solutions and present analysis to management.
    • Oversee classification of products, technologies, and services, understanding and keep informed on existing and future technologies and products to ensure proper development and execution of export classification processes.
    • Drive communication and training to increase compliance with regulations and understanding and awareness of global trade compliance and third-party due diligence and monitoring programs.
    • Promote a culture of trade compliance and ethics through leadership by example mentorship and development of compliance and import/export operations staff.
    • Oversee and guide compliance with tariff classification, country of origin determination, valuation and applicable tax or other regulations, Export Administration Regulations (EAR), Commerce Control List (CCL) and applicable regulations and requirements of the Bureau of Industry and Security (BIS), U.S. Customs, and any other applicable regulations/requirements.
    • Develop strong business partner relationships, including collaborating closely with global business and functional leaders such as Sales, Finance/Accounting, Services, etc.
    • Work with government regulators worldwide to resolve regulatory audits and inquiries, enhance relationships, and promote helpful regulatory change.
    • Advise and leads on drafting strategic export licenses and regulatory filings.
    • Provide oversight of customs audits and other requests or inquiries.


    Other Compliance

    • Develop, advise on and drive compliance with effective anti-corruption policies and procedures governing conflicts of interest, gifts and entertainment, and discounts and incentive programs.
    • Develop trade and anti-bribery and corruption compliance roadmap and strategic planning; manage compliance.
    • Drive implementation of third-party risk management controls, managing risk-based diligence process for third parties.
    • Oversee, improve, and monitor third party due diligence and monitoring program, implement risk management controls, and advise on vendor compliance solutions.
    • Oversee and manage U.S. government contracts compliance.
    • Other duties as assigned.

    EXPERIENCE:
    • Experience working in the semiconductor industry
    • 10 years of experience in global trade compliance including with an in-depth understanding of applicable global export controls, economic sanctions and regulations as well as extensive experience with global trade and third party due diligence and monitoring programs, frameworks, and standard methodologies at multinational companies
    • Proven experience implementing strong compliance programs with high standards to comply with new trade regulations
    • Experience with the BIS, U.S. Customs, OFAC and corresponding regulatory agencies
    • Proven experience in directing and strengthening global trade compliance processes and procedures; building trade controls governance infrastructure
    • Experience in maintaining a database of import data in full compliance with reporting requirements of U.S. Customs
    • Familiarity with data, processes and systems supporting global trade
    • Familiarity with anti-corruption laws and compliance programs
    • Familiarity with third party due diligence and monitoring programs
    • Experience with compliance program management or development
    • Experience working for large, diverse multinational organizations


    EDUCATION:
    Strongly preferred – one or both of:

    • JD
    • US Customs Broker License


    COMPENSATION:
    As required by multiple state pay transparency laws, Advanced Energy provides a reasonable range of compensation for each job posting. Actual compensation is influenced by an array of factors including, but not limited to, skill set, level of experience, and specific office location. The range of starting pay for this role is $170,000 to $200,000 per year.
