This position presides over the Municipal Court whose jurisdiction covers City of Gillette ordinance violations. This position is appointed annually by the City Council.

  • Presides over cases involving violations of City ordinances, including arraignments, bench trials, jury trials, pre-trial hearings, sentencing and show-cause hearings.
  • Determines proper sentencing, monetary fees and damages to be paid upon the completion of a case and hand down the ruling in the courtroom to the responsible party.
  • Manages the Municipal Court docket.
  • Issues warrants, search warrants, subpoenas or other necessary processes for contempt to the same extent as the Circuit and District Court.
  • Issues statewide bench warrants for violation of a city ordinance.
  • Advises inmates of their rights and determines bond for a person charged with a violation of a City ordinance.
  • Oversees the administration of juror notification and directs jurors in trial cases on their role in the interpretation and application of law.
  • Develops rules of practice for the Municipal Court that are consistent with Gillette City Code, and State statutes governing the practices and proceedings of cases before justices of the peace and constables.
  • Stays abreast of new legislation and case law affecting offenses and the criminal justice system.
  • Performs related duties.

  • Knowledge of legal research principles.
  • Knowledge of relevant federal, state and city laws, regulations, and ordinances.
  • Knowledge of the rules of courtroom procedure and the rules of evidence.
  • Knowledge of departmental functions, programs, and services.
  • Knowledge of Wyoming Rules of Criminal Procedure and criminal justice system principles.
  • Knowledge of computers and job-related software programs.
  • Skill in rendering legal decisions and assessment of penalties in a fair and impartial manner.
  • Skill in interpretation and application of Federal, State and local policies, procedures, laws and regulations.
  • Skill in the analysis of problems and the development and implementation of solutions.
  • Skill in oral and written communication.

SUPERVISORY CONTROLS
The City Council employs and appoints this position.

GUIDELINES
Guidelines include local, state, and federal rules, statutes, codes, ordinances and regulations. These guidelines require judgment, selection, and interpretation in application. This position develops department guidelines.

COMPLEXITY/SCOPE OF WORK


  • The work consists of varied legal, management, and supervisory duties. The variety and volume of issues to be managed contributes to the complexity of the position.
  • The purpose of this position is to direct the provision of Municipal Court services for the City of Gillette. Success in this position contributes to the efficiency and effectiveness of the operation.

CONTACTS
  • Contacts are typically with city employees, elected and appointed officials, law enforcement personnel, other attorneys, representatives of law enforcement agencies, members of the news media, and members of the general public.
  • Contacts are typically to provide services; to give or exchange information; to resolve problems; to motivate or influence persons; or to justify, defend or negotiate matters.

PHYSICAL DEMANDS/WORK ENVIRONMENT
  • The work is typically performed while sitting at a desk or table or while intermittently sitting, standing, or stooping. The employee occasionally lifts light and heavy objects.
  • The work is typically performed in an office.

SUPERVISORY AND MANGEMENT RESPONSIBILIITY
This position coordinates with Municipal Court Clerk (1) and Deputy Court Clerk (1).

MINIMUM QUALIFICATIONS
  • Graduation from an accredited school of law.

  • Experience sufficient to thoroughly understand the practice of law or equivalent legal experience, including the objectives and functions of a trial courtroom setting in order to direct and coordinate work within the division/department, usually interpreted to require three to five years of related experience.

  • Current membership in the Wyoming State Bar.
