Qualifications:
Education/Certification
Doctor of Jurisprudence degree from an accredited university
Licensed to practice law in the State of Texas
Texas Teaching Certificate at any level (preferred, not required)
Special Knowledge/Skills
- Knowledge and experience in working with public information requests (preferred).
- Knowledge and experience in negotiating and drafting contracts (preferred).
- Knowledge of local, state, and federal laws, regulations relating to public education.
- Demonstrated legal research and writing skills.
- Ability to interpret law, policy, and procedures.
- Ability to engage in work that is complex and broad in scope covering several departments and divisions across the District.
Experience
No experience required; however, experience in public or private practice dealing with legal issues of local, state, federal government, or public school law preferred.
Primary Purpose:
Assists the General Counsel in providing timely and quality legal advice, services, and professional training to the Board of Education, the superintendent and administrative staff relative to all laws, rules, and regulations affecting education. Represents the district and administrative staff in negotiating and drafting contracts. Represents the district in all matters related to the public information act and its related regulations, policies and procedures. Represents the district and assists in responding to subpoenas.
Major Duties and Responsibilities:
Provide legal advice and coordinate district responses consistent with law for all public information requests, and subpoenas and litigation discovery as needed.
Conduct research and render legal opinion on issues effecting district programs and services, and makes recommendations to general counsel to ensure that the district's programs, services, policies, regulations, guiding documents and handbooks are in compliance with legislative changes, federal laws, and judicial decisions; and assist general counsel as needed in preparing for and in staffing board meetings.
Draft, review, and revise legal documents.
Assist in negotiating and drafting contracts for the acquisition and/or use of real and personal property, construction contracts, and third party vendors.
Perform other duties as assigned.
Policy, Reports, and Law
6. Maintain public information request database and summary log.
7. Assist with compiling, maintaining, and filing all computerized and physical reports, records, and other documents required.
8. Comply with policies established by federal and state law, State Board of Education rule, and local board policy.
Communication
9. Maintain a positive and effective relationship with the General Counsel, administration, and district staff.
10. Able to respond effectively both verbally and in writing, to the most sensitive inquiries or complaints. Ability to effectively communicate under pressure and in situations which require urgent and timely responses.
11. Represent Administration during the formal contract negotiations.
12. Ability to participate in and lead central office level meetings which may require the advice of counsel.
13. Ability to effectively communicate law and policy with administrators in charge of campuses and departments
Supervisory Responsibilities:
No supervisory or direct people management responsibilities. May provide occasional work guidance, technical advice, and training to staff. This position will have access to a paraprofessional administrative assistant.
Equipment Used:
Personal computer, printer, copier, fax machine
Working Conditions:
Maintain emotional control under stress. Frequent district and statewide travel; occasional prolonged and irregular hours. The employee will work in an administrative office environment which may be fast paced and high pressure, with multiple campuses assigned.
