What You'll Do:
The Board regulates over 300,000 licenses and certificates. The Board licenses and regulates registered nurses (RNs), licensed practical nurses (LPNs), Advanced Practice Registered Nurses (APRNs), Dialysis Technicians (DTs), Community Health Workers (CHWs) and Medication Aides. The Board's top priorities are to efficiently license the nursing workforce and remove dangerous practitioners from practice in a timely manner to protect Ohio patients. Public protection is critical, as nursing touches virtually every citizen of Ohio.
The Ohio Board of Nursing is looking for an Attorney 4 position to assist in the Compliance Unit.
The Ohio Board of Nursing currently supports a hybrid teleworking model. This position may work a hybrid schedule at the discretion of the manager or supervisor, which will require occasional attendance in the office training, meeting and other operational needs. Employees myst reside within a reasonable distance from the office for compliance with workplace reporting requirements.
This position will work under direction/supervision of the Chief Enforcement Attorney and will perform the following job duties:
- Assists in administering and implementing the Board of Nursing Adjudication program.
- Reviews completed investigation reports to determine if sufficient evidence exists to propose disciplinary action.
- Consults and confers with Chief Enforcement Attorney and/or Chief Legal Counsel and/or Supervising Member for Disciplinary Matters to determine course of action (e.g., Notice of Opportunity for Hearing, Consent Agreement or Examination Order, eligibility for alternative programs, close due to lack of evidence/no violation, etc.).
- Negotiates pre-notice Consent Agreements.
- Confers with Attorney General’s Office (AGO) staff regarding agency position in settlement conferences/negotiations for post-notice Consent Agreements. Drafts Consent Agreements, Examination Orders and Notices, including Notices of Immediate and Automatic Suspension.
- Ensures documentation of activity on cases in appropriate databases.
- Cooperates with and acts as legal liaison to Assistant Attorney General (AAG) on assigned cases, including drafting post-notice settlement agreements, or at the appellate level, filing certified record in appeals cases.
- Assists in administering and implementing the Board of Nursing program for preparing exhibits and identifying evidence in cases in which no administrative hearing has been requested by the respondent (i.e., “no request cases”).
In accordance with ORC 124.11A(9), this position serves in the unclassified service.
