What you will do?
Partner with HMD commercial and business teams to ensure they conclude contracts in a timely manner and align with all company contract review and approval processes.
- Review discounts, rebates, and other contract levers and tool sets for compliance concerns to improve contracting strategies.
- Serve as commercial contract SME to other functions such as Finance and Sales and contributes to improved understanding of healthcare compliance, reporting requirements and contract obligations.
- Communicate regularly with business leadership, Senior Corporate Counsel for HMD and Corporate Compliance, including status reports of commercial contracts and raising appropriate matters for approval and guidance.
- Support review and response to requests for proposal (RFP) and requests for information (RFI) to optimize commercial opportunities while minimizing any potential risk.
- Develop and update templates, playbooks and other commercial resource documentation and training to address routine legal requests.
Complete duties that may be assigned to meet business needs, including leading compliance initiatives, training, implementation of automation tools and process improvements.
- Anticipate and drive the development of functional solutions and SOPs and documented methodologies for a range of legal and business issues with a specific end goal to shield the organization from legal risks.
- Provide advice regarding customer conflict resolution and other commercial/business disputes and facilitate regulatory review and resolution of complaints.
- Provide guidance on a range of legal, regulatory and compliance matters, including, healthcare fraud and abuse, healthcare transparency laws, commercial antitrust, anti-bribery/FCPA, and data privacy, with some initial oversight.
- Partner with regulatory, quality and compliance colleagues to ensure effective prevention, detection and remediation of violations of law, regulations and internal policies.
- Give advice and counsel on matters related to marketing initiatives. Knowledge of FDA and/or healthcare related restrictions/requirements, highly preferred.
- Collaborate closely with other relevant functions throughout the business, such as corporate accounts, portfolio management, finance, sales and marketing.
- Educate and train employees on their obligations under a variety of applicable laws, regulations and company policies.
How will you get here?
- Juris Doctorate required, and admission to a state Bar
- 5-7 years of commercial contracts and business Legal experience. Mix of law firm and inhouse experience a plus.
- Outstanding eye for business with the ability to translate legal theory into applied business success.
- Collaborative negotiation abilities driving to customer centric solutions that support both external and internal clients while protecting the best interest of the company.
- Experience developing, driving and implementing legal solutions
- Ability to deliver strong results with limited resources, under short deadlines and with a high degree of accuracy
