Job Description
The Compliance Officer (CO) ensures compliance with all outside regulatory and legal requirements as well as internal policies and bylaws. The CO has a duty to work with Community Counseling and Mediation (CCM) management and staff to identify and manage compliance responsibilities. They report directly to CEO and Board of Trustees and serve as the compliance staff by overseeing, monitoring, and reporting results of the compliance/ethics efforts of the agency and in providing guidance for the Board and senior management team on matters relating to NYS OMIG/CMS OIG compliance. The CO, together with the Board and Staff Compliance Committees, is authorized to implement all necessary actions to ensure achievement of the objectives of an effective corporate compliance program. Corporate compliance encompasses the contracted provider State and city licensing bodies, OASAS, NYS OMIG, CMS, HHS (HIPAA/FERPA), OMH, and DOHMH.
The CO is responsible for directly overseeing all NYS OMIG compliance activities throughout the organization, ensuring they are completed by responsible parties. Serving as a repository for all compliance activities and records. Chairing and or participating in committees related to various compliance mandates.
Primary Responsibilities
The CO is responsible for ensuring CCM is demonstrating through action and documentation their commitment to establishing and maintaining an effective Compliance Plan. Policies and procedures and Code of Conduct that are committed to maintaining compliance with applicable federal, state, and local laws, rules, and regulations as well as healthcare industry standards and ethical standards of business conduct.
The CO is responsible to oversee, respond to, investigate, and report on the following to include but not limited to:
- Perform an annual self-assessment using the NYS OMIG self-assessment tool.
- Make recommendations, receive approval for and implement changes to policies, training, processes, and workflows in response to the assessment findings.
- Work to keep all affected parties in compliance.
- Ensure compliance activities are well-integrated into CCM’s operations and supported by the highest levels of the organization, including the chief executive, senior management, and the governing body.
- Promotes adherence to CCM’s legal and ethical obligations; and
- Ensure the compliance plan and its activities are applied to all nine areas of applicability. Billings

- Reports directly, on a regular basis, but no less frequently than quarterly, to the required provider’s governing body, chief executive, and compliance committee on the progress of adopting, implementing, and maintaining the compliance program.
- Assists the required provider in establishing methods to improve the required provider’s efficiency, quality of services, and reducing the required provider’s vulnerability to fraud, waste, and abuse.
- Independently acting on matters related to the compliance program, including designing, and coordinating internal investigations and documenting, reporting, coordinating, and pursuing any resulting corrective action with all internal departments, contractors, and the State.
- Provides consultation and guidance to leadership on compliance issues.
- Approves classes and materials and provides consultation and training to new house staff and employees; conducts annual mandatory training programs and periodic inservices for staff.
- Ensures the creation and maintenance of current compliance and HIPPA policies, Compliance Manual and Code of Conduct documents recommending changes as indicated by new regulations.
- Oversees all areas of compliance throughout CCM and contributes to the risk management of these areas. [see corporate compliance matrix]
- Develops, initiates, maintains, and revises policies and procedures for the general operation of the NYS part 521/363-d Compliance Program and its related activities to prevent illegal, unethical, or improper conduct in relation to the 8 elements. Manages day-to-day operation of the Program.
- Develops and periodically reviews and updates Standards of Conduct to ensure continuing currency and relevance in providing guidance to management and employees.
- Collaborates with other departments (e.g., HR, IT, Finance, Facilities) to oversee compliance with mandates and direct compliance issues to appropriate existing channels for investigation and resolution. Consults with the Corporate attorney as needed to resolve difficult legal compliance issues.
- Responds to alleged violations of rules, regulations, policies, procedures, and Standards of Conduct by evaluating or recommending the initiation of investigative procedures. Develops and oversees a system for uniform handling of such violations.
- Acts as an independent review and evaluation body to ensure that compliance Issues/concerns and incidents within the organization are being appropriately evaluated, investigated, and resolved.
- Monitors, and as necessary, coordinates compliance activities of other departments to remain abreast of the status of all compliance activities and to identify trends.
- Identifies potential areas of compliance vulnerability and risk; develops/implements corrective action plans for resolution of problematic issues and provides general guidance on how to avoid or deal with similar situations in the future.
- Provides reports on a regular basis, and as directed or requested, to keep the Compliance Committee of the Board and senior management informed of the operation and progress of compliance efforts.
- Ensures proper reporting of violations or potential violations to duly authorized enforcement agencies as appropriate and/or required.
- Establishes and provides direction and management of the compliance Hotline.
- Institutes and maintains an effective compliance communication program for the organization, including promoting (a) use of the Compliance Hotline; (b) heightened awareness of Standards of Conduct, and (c) understanding of new and existing compliance issues and related policies and procedures.
- Oversees an effective compliance training program, including appropriate introductory training for new employees as well as ongoing training for all employees and managers.

Administrative Responsibilities
- Chairs Compliance Committee meetings
- Prepares reports for the CEO and board monthly of all compliance activities. Reports in person at board meetings no less than bi-annually.
- Keep abreast of changes in technology and regulatory issues that may affect our business and clients.
- Suggest ideas that may improve audit workflows.
Qualification
- Education: Bachelor's or master's degree in healthcare administration, business, law, or related field.
- Experience: Relevant experience in healthcare compliance or regulatory affairs.
- Knowledge: Familiarity with state and city licensing bodies, OASAS, NYS OMIG, CMS, HHS (HIPAA/FERPA), OMH, and DOHMH regulations.
- Communication Skills: Strong communication and analytical skills.
- Certification: Preferred certification in healthcare compliance (e.g., CHC).
- Detail-Oriented: Strong attention to detail for identifying and addressing compliance issues.
